The Secretary of State for Business, Innovation and Skills makes the following Regulations in exercise of the powers conferred by sections 83A(6)(b) and 262(1)(a) of the Apprenticeships, Skills, Children and Learning Act 2009(1).

Citation and commencement

1.  These Regulations may be cited as the Apprenticeships (the Apprenticeship Offer) (Prescribed Persons) Regulations 2013 and come into force on 6th April 2013.

Prescribed persons

2.  For the purposes of section 83A(6)(b) of the Apprenticeships, Skills, Children and Learning Act 2009, a person is of a prescribed description if that person is—

(a)aged 19 or over but under 25; and

(b)has a disability within the meaning of section 6(1) of the Equality Act 2010(2).

EXPLANATORY NOTE

(This note is not part of the Regulations)

Under section 83A of the Apprenticeships, Skills, Children and Learning Act 2009 (c.22), the Chief Executive of Skills Funding is under a duty to prioritise funding for apprenticeship training for specified groups of young people who have an apprenticeship opportunity (“the apprenticeship offer”). These Regulations prescribe a further category of persons for the purposes of the apprenticeship offer, namely persons who have a disability within the meaning of section 6(1) of the Equality Act 2010, that is a physical or mental impairment where such impairment has a substantial and long-term adverse effect on their ability to carry out normal day-to-day activities.

An impact statement has not been prepared for this instrument as no impact on the private or voluntary sectors is foreseen. The Explanatory Memorandum is published alongside these Regulations on www.legislation.gov.uk.
