The Secretary of State, in exercise of the powers conferred by section 128(2) of the Serious Organised Crime and Police Act 2005(1), makes the following Order:
1.—(1) This Order may be cited as the Serious Organised Crime and Police Act 2005 (Designated Sites under Section 128) (Amendment) Order 2014 and shall come into force on 26th March 2014.
(2) This Order extends to England and Wales only.
2.—(1) The Serious Organised Crime and Police Act 2005 (Designated Sites under Section 128) Order 2007(2) is amended as follows.
(2) In article 2(1)(g), for “the sites described in paragraphs (2) to (14)” substitute “the sites described in paragraphs (2), (3) and (5) to (14).”
(3) Omit article 2(4) and Schedule 3.

Under section 128 of the Serious Organised Crime and Police Act 2005 it is an offence to enter or be on any designated site in England and Wales or Northern Ireland as a trespasser. A “designated site” is a site specified or described in an order made under section 128 which designates the site for the purpose of that section. Article 2(4) of the Serious Organised Crime and Police Act 2005 (Designated Sites under Section 128) Order 2007 (“the 2007 Order”) designates the Government Communications Headquarters site at Harp Hill, Cheltenham, GL52 2AU, as marked in Schedule 3 to the 2007 Order. Article 2 of this Order amends the 2007 Order by omitting article 2(4) of, and Schedule 3 to, the 2007 Order, so that it ceases to be an offence to enter or be on the Harp Hill site as a trespasser.
A full regulatory impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
2005 c.15. Section 128 has been amended by section 12 of the Terrorism Act 2006 (c. 11).
