The Secretary of State for Education makes the following Regulations in exercise of the powers conferred by sections 408, 563 and 569(4) of the Education Act 1996(1):
The Secretary of State has consulted with those persons with whom consultation appeared to the Secretary of State to be desirable, in accordance with section 408(5) of the Education Act 1996.
1. These Regulations may be cited as the Education (Pupil Information) (England) (Amendment) Regulations 2018 and come into force on 1st September 2018.
2. Schedule 1 to The Education (Pupil Information) (England) Regulations 2005(2) is amended as follows—
(a)in paragraph 2(2)(a) after “P Scale 4” omit “or above”,
(b)in paragraph 2(2)(b) after “P Scale 4” omit “or above”, and
(c)omit sub-paragraph 2(2)(c).
3. Schedule 2 to The Education (Pupil Information) (England) Regulations 2005 is amended as follows—
(a)in paragraph 6(3)(a) after “P Scale 4” omit “or above”,
(b)in paragraph 6(3)(b) after “P Scale 4” omit “or above”, and
(c)omit sub-paragraphs (c) and (d).

These Regulations amend the Education (Pupil Information) (England) Regulations 2005.
They provide that the information to be included in the head teacher’s report to parents for pupils with special educational needs in key stage 2 must include the pupil’s assessment in English and mathematics and remove the reporting requirement for science.
The Regulations also amend the information to be included in the common transfer file when a pupil in the first or second key stage has been assessed against P Scales of attainment moves from a maintained school to another school (whether maintained or not) to include the pupil’s assessment in English and mathematics.
The Regulations also remove the inclusion of the reporting requirements in science and other foundation subjects.
1996 c.56; Section 408 was amended by Schedule 30, paragraph 106(b) to the Schools Standards and Framework Act 1998 c.31; Schedule 9 paragraph 57(3) of the Learning and Skills Act 2000 (c.21); Schedule 21 paragraph 46(4) to the Education Act 2002 (c.32) and to S.I. 2010/1158. Section 563 was amended by Schedule 30 paragraph 172 to the School Standards and Framework Act 1998 (c.30) and S.I. 2010/1158. Section 569 was amended by Schedule 18 paragraph 1 to the Education and Inspections Act 2006 (c.40). There are other amendments not relevant to these Regulations.
