The Secretary of State, in exercise of the powers conferred by section 8(1) of the European Union (Withdrawal) Act 2018(1), makes the following Regulations.

The requirements of paragraph 3(2) of Schedule 7 to that Act (relating to the appropriate Parliamentary procedure for these Regulations) have been satisfied.

PART 1

Citation and commencement

1.—(1) These Regulations may be cited as the Guarantees of Origin of Electricity Produced from High-efficiency Cogeneration and Renewables Obligation (Amendment) (EU Exit) Regulations 2020.

(2) These Regulations come into force immediately before IP completion day.

PART 2Amendment of the Guarantees of Origin of Electricity Produced from High-efficiency Cogeneration (Amendment) (EU Exit) Regulations 2018

2.—(1) The Guarantees of Origin of Electricity Produced from High-efficiency Cogeneration (Amendment) (EU Exit) Regulations 2018(2) are amended as follows.

(2) in regulation 3(5)(c)(ii), for “exit day” substitute “IP completion day”;

(3) in regulation 4(6)(c)(ii), for “exit day” substitute “IP completion day”.

PART 3Amendment of the Renewables Obligation (Amendment) (EU Exit) Regulations 2019

3.—(1) The Renewables Obligation (Amendment) (EU Exit) Regulations 2019(3) are amended as follows.

(2) In Schedule 1, in the text to be inserted by paragraph 5(4), for “exit day” substitute “IP completion day”.

(3) In Schedule 2, in the text to be inserted by paragraph 2(4), for “exit day” substitute “IP completion day”.

(4) In Schedule 3, in the text to be inserted by paragraph 2(4), for “exit day” substitute “IP completion day”.

EXPLANATORY NOTE

(This note is not part of these Regulations)

These Regulations are made in exercise of the powers conferred by section 8(1) of the European Union (Withdrawal) Act 2018 (c. 16) in order to address failures of retained EU law to operate effectively and other deficiencies (in particular under section 8(2)(g) arising from the withdrawal of the UK from the European Union).

Part 2 amends the Guarantees of Origin of Electricity Produced from High-efficiency Cogeneration (Amendment) (EU Exit) Regulations 2018 (S.I. 2018/1206) to replace references to exit day with references to IP completion day in amendments to the Guarantees of Origin of Electricity Produced from High-efficiency Cogeneration Regulations 2007 and the Guarantees of Origin of Electricity Produced from High-efficiency Cogeneration Regulations (Northern Ireland) 2008.

Part 3 amends the Renewables Obligation (Amendment) (EU Exit) Regulations 2019 (S.I. 2019/35) to replace references to exit day with references to IP completion day in amendments to the Renewables Obligation Order 2015, the Renewables Obligation (Scotland) Order 2009 and the Renewables Obligation Order (Northern Ireland) 2009.

A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sector is foreseen.
