The Secretary of State makes the following Regulations in exercise of the powers conferred by sections 89(1), (2)(b) and (3) and 213(2)(d) and (f) of the Water Industry Act 1991(1).
In accordance with section 213(1A)(2) of the Water Industry Act 1991, a draft of this instrument has been laid before Parliament and approved by a resolution of each House of Parliament.
1991 c. 56; section 89 is amended by section 175(5) of the Health and Care Act 2022 (c. 31) (“the 2022 Act”). There are other amendments, but none is relevant to this instrument.
Section 213(1A) was inserted by section 58(8) of the Water Act 2003 (c. 37) and amended by section 37(3) of the Water Act 2014 (c. 21). Section 175(9) of the 2022 Act provides that the reference in section 213(1A) of the Water Industry Act 1991 to the first exercise of the power to make regulations under section 89 of that Act is to be read as a reference to the first exercise of the power to make regulations under that section as amended by section 175(5) of the 2022 Act.
