9.—(1) Bydd person sy'n euog o dramgwydd o dan reoliad 7 yn agored, o'i gollfarnu'n ddiannod—

(a)i garchar am gyfnod heb fod yn hwy na 51 wythnos;

(b)i ddirwy heb fod yn fwy na lefel 4 ar y raddfa safonol; neu

(c)i'r cyfnod o garchar y cyfeirir ato yn is-baragraff (a) yn ogystal â'r ddirwy y cyfeirir ati yn is-baragraff (b).

(2) Mewn perthynas â thramgwydd a gyflawnwyd cyn cychwyn adran 281(5) o Ddeddf Cyfiawnder Troseddol 2003(1), rhaid deall y cyfeiriad ym mharagraff (1)(a) at 51 wythnos fel cyfeiriad at 6 mis.
