Mae Gweinidogion Cymru yn gwneud y Rheoliadau a ganlyn drwy arfer y pwerau a roddwyd gan adrannau 16(1)(e), 17(2), 26(1)(a) a (3) a 48(1) o Ddeddf Diogelwch Bwyd 1990(1) ac a freiniwyd bellach ynddynt hwy(2).
Mae'r Rheoliadau hyn yn gwneud darpariaeth ar gyfer diben a grybwyllir yn adran 2(2) o Ddeddf y Cymunedau Ewropeaidd 1972(3) ac mae'n ymddangos yn hwylus i Weinidogion Cymru i unrhyw gyfeiriad at yr Atodiad i Reoliad y Comisiwn (EC) Rhif 953/2009 am sylweddau y caniateir eu hychwanegu at ddibenion maethol penodol mewn bwydydd at ddefnydd maethol neilltuol(4) gael ei ddehongli fel cyfeiriad at yr Atodiad hwnnw fel y'i diwygir o bryd i'w gilydd.
Yn unol ag adran 48(4A) o Ddeddf Diogelwch Bwyd 1990, mae Gweinidogion Cymru wedi rhoi sylw i gyngor perthnasol a roddwyd gan yr Asiantaeth Safonau Bwyd.
Fel sy'n ofynnol gan Erthygl 9 o Reoliad (EC) Rhif 178/2002 Senedd Ewrop a'r Cyngor, sy'n gosod egwyddorion cyffredinol a gofynion cyfraith bwyd, yn sefydlu Awdurdod Diogelwch Bwyd Ewrop ac yn gosod gweithdrefnau o ran materion diogelwch bwyd(5), cafwyd ymgynghori agored a thryloyw â'r cyhoedd tra'r oedd y Rheoliadau hyn yn cael eu paratoi a'u gwerthuso.

Cafodd swyddogaethau'r Ysgrifennydd Gwladol, i'r graddau y maent yn arferadwy o ran Cymru, eu trosglwyddo i Gynulliad Cenedlaethol Cymru gan Orchymyn Cynulliad Cenedlaethol Cymru (Trosglwyddo Swyddogaethau) 1999 (O.S. 1999/672) a'u trosglwyddo wedi hynny i Weinidogion Cymru gan baragraff 30 o Atodlen 11 i Ddeddf Llywodraeth Cymru 2006 (2006 p.32).
