Mae Gweinidogion Cymru, drwy arfer y pŵer a roddwyd iddynt gan adran 39(4) o Ddeddf Safonau a Threfniadaeth Ysgolion (Cymru) 2013(1), yn gwneud y Gorchymyn a ganlyn:

Enwi

1.  Enw’r Gorchymyn hwn yw Gorchymyn y Cod Trefniadaeth Ysgolion (Diwrnod Penodedig) (Cymru) 2018.

Diwrnod Penodedig

2.  Y diwrnod a bennir fel y diwrnod y daw’r Cod Trefniadaeth Ysgolion (y gosodwyd copi o ddrafft ohono gerbron Cynulliad Cenedlaethol Cymru ar 17 Medi 2018) i rym yw 1 Tachwedd 2018.

(Nid yw’r nodyn hwn yn rhan o’r Gorchymyn)

Mae’r Gorchymyn hwn yn pennu 1 Tachwedd 2018 fel y diwrnod y daw’r Cod Trefniadaeth Ysgolion (“y Cod”) a ddyroddwyd gan Weinidogion Cymru o dan adrannau 38 a 39 o Ddeddf Safonau a Threfniadaeth Ysgolion (Cymru) 2013 (“DSThY 2013”) i rym.

Mae’r Cod yn disodli’r Cod Trefniadaeth Ysgolion a ddaeth i rym ar 1 Hydref 2013.

Mae’r Cod yn gosod gofynion ac yn cynnwys canllawiau sy’n nodi nodau, amcanion neu faterion eraill mewn perthynas â chynigion trefniadaeth ysgolion a wnaed o dan Ran 3 o DSThY 2013. O dan adran 38(4) o DSThY 2013, dyletswydd Gweinidogion Cymru, awdurdodau lleol, cyrff llywodraethu ysgolion a gynhelir a phersonau eraill, wrth arfer swyddogaethau o dan Ran 3 o DSThY 2013, yw gweithredu yn unol ag unrhyw ddarpariaethau perthnasol yn y Cod. Yn ogystal, rhaid i unrhyw berson arall, wrth arfer unrhyw swyddogaeth at ddiben cyflawni swyddogaethau gan Weinidogion Cymru, awdurdod lleol neu gorff llywodraethu ysgol a gynhelir o dan y Rhan honno, weithredu yn unol ag unrhyw ddarpariaethau perthnasol yn y Cod.
