Changes to Legislation

Ar hyn o bryd mae unrhyw newidiadau neu effeithiau hysbys a wnaed gan ddeddfwriaeth ddilynol wedi'u gwneud i destun y ddeddfwriaeth yr ydych yn edrych arni gan y tîm golygyddol. Gweler 'Cwestiynau Cyffredin' am fanylion ynglŷn â'r amserlenni ar gyfer nodi a chofnodi effeithiau newydd ar y safle hwn.
Sefydlu ardaloedd a ddarnodir a mesurau sydd i’w cymryd yn yr ardaloedd hynnyLL+C
17.—(1) [F1Mae paragraff (2)] yn gymwys pan fo awdurdod priodol wedi cadarnhau’n swyddogol bresenoldeb pla planhigion a reolir nad yw’n hysbys ei fod yn bresennol yng Nghymru neu bresenoldeb pla planhigion a reolir mewn ardal o Gymru lle nad oedd yn bresennol o’r blaen.
(2) Caiff awdurdod priodol drwy hysbysiad—
(a)darnodi ardal mewn perthynas â phresenoldeb y pla planhigion a reolir at ddiben dileu neu gyfyngu’r pla planhigion;
(b)pennu’r gwaharddiadau neu’r cyfyngiadau sydd i fod yn gymwys i’r ardal a ddarnodir at y diben hwnnw.
[F2(2A) Mae paragraff (2B) yn gymwys pan fo’r awdurdod cymwys mewn perthynas ag un arall o diriogaethau Prydain Fawr—
(a)wedi cadarnhau’n swyddogol fod pla planhigion y mae Erthygl 18 o’r Rheoliad Iechyd Planhigion yn gymwys iddo yn bresennol yn ei diriogaeth; a
(b)wedi hysbysu’r awdurdod cymwys mewn perthynas â Chymru, yn unol ag Erthygl 18(4A) o’r Rheoliad Iechyd Planhigion”, y dylai ardal ddarnodedig ymestyn i Gymru neu gael ei sefydlu yng Nghymru.
(2B) Caiff yr awdurdod cymwys drwy hysbysiad—
(a)darnodi ardal er mwyn dileu neu gyfyngu’r pla planhigion, neu er mwyn atal y pla rhag ymsefydlu yng Nghymru; neu
(b)cadarnhau’r bwriad i ddarnodi ardal yng Nghymru a hysbyswyd yn flaenorol i’r awdurdod cymwys gan awdurdod cymwys arall yn unol ag Erthygl 18(4A) o’r Rheoliad Iechyd Planhigion.
(2C) Caiff hysbysiad o dan baragraff (2B) bennu’r gwahardddiadau neu’r cyfyngiadau sydd i fod yn gymwys i’r ardal ddarnodedig at unrhyw un neu ragor o’r dibenion a bennir yn y paragraff hwnnw.]
(3) O ran hysbysiad o dan baragraff (2) [F3neu (2B)]—
(a)rhaid iddo fod mewn ysgrifen;
(b)rhaid iddo ddisgrifio hyd a lled yr ardal a ddarnodir;
(c)rhaid iddo bennu ar ba ddyddiad y bydd unrhyw waharddiadau neu gyfyngiadau o’r fath yn cychwyn;
(d)rhaid iddo gael ei gyhoeddi mewn modd sy’n briodol i ddod ag ef i sylw’r cyhoedd;
(e)caniateir iddo gael ei ddiwygio neu ei ddirymu, yn gyfan gwbl neu’n rhannol, drwy hysbysiad arall.
