10.—(1) Ar ôl diwedd y cyfnod ar gyfer gwneud sylwadau a gwrthwynebiadau, rhaid i’r awdurdod priodol benderfynu p’un ai i osod y gofynion a ddisgrifir yn yr hysbysiad o fwriad, gyda neu heb addasiadau.
(2) Pan fo’r awdurdod priodol yn penderfynu gosod gofyniad, rhaid i’r hysbysiad sy’n ei osod (yr “hysbysiad terfynol”) gydymffurfio â pharagraff 11 (ar gyfer hysbysiadau cydymffurfio neu hysbysiadau adfer) neu 12 (ar gyfer cosbau ariannol penodedig neu amrywiadwy).
(3) Ni chaiff yr awdurdod priodol osod hysbysiad terfynol ar berson pan fo’r awdurdod priodol wedi ei fodloni na fyddai’r person hwnnw, oherwydd unrhyw amddiffyniad, hawlen neu drwydded, yn agored i gael ei euogfarnu o’r drosedd y mae’r hysbysiad yn ymwneud â hi.
(4) Pan fo’r awdurdod priodol yn cyflwyno hysbysiad terfynol sy’n ymwneud â chosb ariannol benodedig mewn cysylltiad ag unrhyw drosedd, ni chaiff yr awdurdod priodol mewn perthynas â’r drosedd honno gyflwyno—
(a)hysbysiad cydymffurfio,
(b)hysbysiad adfer,
(c)hysbysiad yn gosod cosb ariannol amrywiadwy, neu
(d)hysbysiad stop.
