The Welsh Ministers, in exercise of the power conferred by Article 38 of Regulation (EU) No 576/2013 of the European Parliament and of the Council on the non-commercial movement of pet animals(1), make the following Regulations.

In accordance with Article 39(7) of that Regulation(2), before making these Regulations, the Welsh Ministers have consulted such bodies and persons as appear to them to be representative of the interests likely to be substantially affected by these Regulations and such other bodies or persons as the Welsh Ministers consider appropriate.

Title, commencement, expiry, application and extent

1.—(1) The title of these Regulations is The Non-Commercial Movement of Pet Animals (Amendment) (Wales) (No. 2) Regulations 2022.

(2) These Regulations come into force on 1 October 2022 and expire on 1 April 2023

(3) These Regulations apply in relation to Wales, and extend to England and Wales.

Revocation

2.  The Non-Commercial Movement of Pet Animals (Amendment) (Wales) Regulations 2022(3) are revoked from 1 October 2022.

Amendments to Regulation (EU) No 576/2013

3.—(1) Regulation (EU) No 576/2013 of the European Parliament and of the Council on the non-commercial movement of pet animals(4) is amended as follows.

(2) In Annex 4 (Validity requirements for the rabies antibody titration test)—

(a)in point 2(b), at the end insert “, except where point 2A applies”;

(b)after point 2, insert—

2A.  This point applies where, the Welsh Ministers have administered a test which measures a level of antibody to rabies virus in serum of the animal tested equal to or greater than 0.3 EU/ml and using an enzyme linked immunosorbent assay method that meets the validation standards set out in Chapter 1.1.6 of the Manual of Diagnostic Tests and Vaccines for Terrestrial Animals 2022;(5).

EXPLANATORY NOTE

(This note is not part of the Regulations)

Regulation 2 revokes The Non-Commercial Movement of Pet Animals (Amendment) (Wales) Regulations 2022 from 1 October 2022.

Regulation 3 amends Regulation (EU) No 576/2013 of the European Parliament and of the Council on the non-commercial movement of pet animals (EUR 576/2013), to permit the use of an alternative antibody titre test for pet animals entering Wales from a third country, for a further period of 6 months following the expiry and revocation of The Non-Commercial Movement of Pet Animals (Amendment) (Wales) Regulations 2022. These Regulations expire on 1 April 2023.

A copy of the validation standard referred to in regulation 3 can be inspected at the office of the Welsh Government, Cathays Park, Cardiff, CF10 3NQ.

The Welsh Ministers’ Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to this Order. As a result, it was not considered necessary to carry out a Regulatory Impact Assessment as to the likely costs and benefits of complying with these Regulations.
