of 13 September 2011

on the notification of a proposal for amendment to the Annexes to the EC-US Agreement on trade in wine

(2011/751/EU)

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Council Decision 2006/232/EC of 20 December 2005 on the conclusion of the Agreement between the European Community and the United States of America on trade in wine(1), and in particular Article 3 thereof,

Whereas:

(1) The Annexes to the Agreement between the European Community and the United States of America on trade in wine should be amended in order to take into account legislative changes regarding oenological practices in the Union, new Union names of origin, new US names of viticultural significance and changes in addresses.

(2) In accordance with Article 11(5) of the Agreement it is necessary in order to amend an Annex to the Agreement to notify the other Party in writing of a proposal for amendment.

(3) The attached proposal for amendment should therefore be notified to the United States of America.

(4) The measure provided for in this Decision is in accordance with the opinion of the Management Committee for the Common Organisation of Agricultural Markets,

HAS DECIDED AS FOLLOWS:

Article 1U.K.

In accordance with Article 11(3)(b) of the Agreement between the European Community and the United States of America on trade in wine, the proposal for amendment to the Annexes to the Agreement set out in the Annex shall be notified in writing to the United States of America.

Article 2U.K.

The Director General for Agriculture and Rural Development is hereby authorised to notify the proposal for amendment on behalf of the European Union.

(1)Annex I point (b) is replaced by the following:U.K.

1.The provisions listed in paragraph 2 concern wine-making practices authorised under the laws, regulations and requirements of the European Union, as referred to in Article 3 and 4, authorised on or before 1 April 2010. Wine treated with Aleppo pine resin designated as Retsina shall not be regarded by the United States as containing a flavoring within the meaning of Article 3(1).
