3.—(1) The Insolvency Act 1986 is amended as follows.
(2) In section 389A (authorisation of nominees and supervisors)(1), in subsection (3)(c), for “section 125(1) of the Mental Health (Scotland) Act 1984” substitute “section 329(1) of the Mental Health (Care and Treatment) (Scotland) Act 2003”.
(3) In section 390 (persons not qualified to act as insolvency practitioners)(2), in subsection (4)(c), for “section 125(1) of the Mental Health (Scotland) Act 1984” substitute “section 329(1) of the Mental Health (Care and Treatment) (Scotland) Act 2003”.
Section 389A was inserted by the Insolvency Act 2000 (c. 39), section 4. There have been other amendments not relevant to this Order.
Section 390 was amended by the Enterprise Act 2002 (c. 40), Schedule 21, paragraph 4. There have been other amendments not relevant to this Order.
