29.—(1) The Housing Benefit and Council Tax Benefit (General) Amendment Regulations 2005 M1 shall be amended in accordance with the following provisions of this paragraph.
(2) For regulation 1(2), substitute—
“(2) In these Regulations—
“the Council Tax Benefit Regulations” means the Council Tax Benefit Regulations 2006;
“the Council Tax Benefit (State Pension Credit) Regulations” means the Council Tax Benefit (Persons who have attained the qualifying age for state pension credit) Regulations 2006;
“the Housing Benefit Regulations” means the Housing Benefit Regulations 2006;
“the Housing Benefit (State Pension Credit) Regulations” means the Housing Benefit (Persons who have attained the qualifying age for state pension credit) Regulations 2006.”.
(3) In regulation 2, for the words “In regulation 98 of the Housing Benefit Regulations”, substitute “ In both regulation 99 of the Housing Benefit Regulations and regulation 80 of the Housing Benefit (State Pension Credit) Regulations, ”.
(4) In regulation 3, for the words “In regulation 83 of the Council Tax Benefit Regulations”, substitute “ In both regulation 82 of the Council Tax Benefit Regulations and regulation 67 of the Council Tax Benefit (State Pension Credit) Regulations, ”.
(5) In regulation 4—
(a)in paragraph (1), for the words “Regulation 99 of the Housing Benefit Regulations”, substitute “ Both regulation 100 of the Housing Benefit Regulations and regulation 81 of the Housing Benefit (State Pension Credit) Regulations ”;
(b)in paragraph (2) after “(2)”, insert “ of both Regulations ”;
(c)in paragraph (3) after “(3)”, insert “ of both Regulations ”;
(d)in paragraph (4), after “(4), insert “ of both Regulations ”.
(6) In regulation 5, for the words “In regulation 84(5) of the Council Tax Benefit Regulations”, substitute “ In both regulation 83(5) of the Council Tax Benefit Regulations and regulation 68(5) of the Council Tax Benefit (State Pension Credit) Regulations ”.
(7) In regulation 6—

(b)in paragraph (2), after “(1)(b)” insert “ of both regulations ”;

(d)in paragraph (4)—

“(4A) After paragraph (3) of regulation 82 of the Housing Benefit (State Pension Credit) Regulations, insert—
“(3A) For the purposes of paragraph (2)(a)(ii), “overpayment arose in consequence of an official error” shall have the same meaning as in regulation 81(3) above.””; and
(f)in paragraph (5), after “(4)” insert “ of both regulations ”.
(8) In regulation 7—
(a)for the words “Regulation 102 of the Housing Benefit Regulations”, substitute “ Both regulation 102 of the Housing Benefit Regulations and regulation 83 of the Housing Benefit (State Pension Credit) Regulations ”;
(b)in paragraph (2), after “(3)”, insert “ of both regulations ”;
(c)in paragraph (3), after “(1)”, insert “ of both regulations ”;

(11) In regulation 10, for the words “In regulation 91(1)(b) of the Council Tax Benefit Regulations”, substitute “ In both regulation 90(1)(b) of the Council Tax Benefit Regulations and regulation 75(1)(b) of the Council Tax Benefit (State Pension Credit) Regulations ”.
