7.—(1) [F1Subject to paragraph (3),] it shall be lawful for the [F2Secretary of State] to adopt rules of eligibility for awards by any training provider to which it makes grants, loans or other payments under [F3section 14 of the Education Act 2002] which confine eligibility to those persons who fall within [F4any of paragraphs 2, 2A, 3, 4, 4A, 4B, 4C, 4D, 4E, 5 [F5, 5A], 6A, 7A, 8A, 9A, 9B, [F69BA,] 9C, 9D, 9E, 10A, 11A, 12A and 13 of] Schedule 1.
(2) [F1Subject to paragraph (3),] it shall be lawful for a training provider who is receiving financial support under [F3section 14 of the Education Act 2002] to adopt rules of eligibility for awards which confine eligibility to those persons who fall within [F4any of paragraphs 2, 2A, 3, 4, 4A, 4B, 4C, 4D, 4E, 5 [F5, 5A], 6A, 7A, 8A, 9A, 9B, [F79BA,] 9C, 9D, 9E, 10A, 11A, 12A and 13 of] Schedule 1.
[F8(3) In relation to an award made on or after 1st January 2028, paragraphs (1) and (2) have effect as if, in each case, they did not mention paragraphs [F98A, [F109B, 9BA and 9E],] of Schedule 1.]
