39. In Schedule A1—
(a)in paragraph 1, omit the definition of “Council Regulation”;
(b)in paragraph 3(3), for “Article 14(3) fourth indent of the Council Regulation”, substitute “regulation 20A of the Plant Breeders’ Rights Regulations 1998(1)”;
(c)in paragraph 4, for “Article 14(3) third indent of the Council Regulation”, substitute “section 9(10) of the Plant Varieties Act 1997(2)”.
