5.—(1) Article 4 is amended as follows.
(2) After paragraph (2) insert—
“(2A) For the purposes of this Order, the amount of an aircraft operator’s aviation emissions from biofuel must be treated as zero where the emission factor of the biofuel under the Monitoring and Reporting Regulation 2018(1) is zero.”.
“Monitoring and Reporting Regulation 2018” is defined in article 4(1) of S.I. 2020/1265 as Commission Implementing Regulation (EU) 2018/2066 of 19 December 2018. Article 24 of that Order provides that the Regulation has effect for the purposes of the UK Emissions Trading Scheme, subject to modifications set out in Schedule 4 to that Order.
