The Social Security (Amendment) (Northern Ireland) Order 1993

The Queen’s Most Excellent Majesty in Council

Whereas a draft of this Order has been approved by a resolution of each House of Parliament:

Now, therefore, Her Majesty, in exercise of the powers conferred by paragraph 1 of Schedule 1 to the Northern Ireland Act 1974(1) and of all other powers enabling Her in that behalf, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:—

Title and commencement

1.—(1) This Order may be cited as the Social Security (Amendment) (Northern Ireland) Order 1993.

(2) This Order shall come into operation on the expiration of 7 days from the day on which it is made.

Interpretation

2.  The Interpretation Act (Northern Ireland) 1954(2) shall apply to Article 1 and the following provisions of this Order as it applies to a Measure of the Northern Ireland Assembly.

Amendment of Social Security Acts

3.—(1) The following paragraph is added after section 5(1)(s) of the Social Security Administration (Northern Ireland) Act 1992(3)—

(t)for treating any payment on account made by virtue of paragraph (s) above as made on account of any benefit to which this section applies that is subsequently awarded or paid..

(2) The following definition is inserted after the definition of “child” in section 133(1) of the Social Security Contributions and Benefits (Northern Ireland) Act 1992(4)—

“dwelling” means any residential accommodation, whether or not consisting of the whole or part of a building and whether or not comprising separate and self-contained premises;.

(3) The following subsection is inserted after section 171(6) of the Social Security Contributions and Benefits (Northern Ireland) Act 1992—

(6A) Regulations under Part VII of this Act relating to housing benefit administered by the Department of the Environment under section 126(3)(b) of the Administration Act shall not be made without the consent of that Department..

(4) The amendments made by this Article shall be deemed always to have had effect.

Explanatory Note

(This note is not part of the Order)

This Order makes detailed amendments of the Social Security Administration (Northern Ireland) Act 1992 and the Social Security Contributions and Benefits (Northern Ireland) Act 1992, which consolidated the law relating to social security. The amendments, which are retrospective, insert provisions which were part of the statute law immediately before those Acts came into operation.
