The Department for Social Development, in exercise of the powers conferred by sections 122(1)(a), 132(3) and (4)(b) and 171(1), (3) and (4) of the Social Security Contributions and Benefits (Northern Ireland) Act 1992(1), and now vested in it(2), and of all other powers enabling it in that behalf, hereby makes the following Regulations:

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Income Support (General) (Amendment) Regulations (Northern Ireland) 2001 and shall come into operation on 29th March 2001.

(2) The Interpretation Act (Northern Ireland) 1954(3) shall apply to these Regulations as it applies to an Act of the Assembly.

Amendment of the Income Support (General) Regulations

2.  In the Income Support (General) Regulations (Northern Ireland) 1987(4)––

(a)in regulation 26(5) (calculation of income and capital of students), for the words from “have effect” to the end of the regulation, there shall be substituted “have effect in relation to students and their partners subject to the modifications set out in Chapter VIII thereof (students)”;

(b)for the title to Chapter VIII of Part V, there shall be substituted “STUDENTS”;

(c)in Schedule 9 (sums to be disregarded in the calculation of income other than earnings)—

(i)in paragraph 59(1)(6), for “full-time student” there shall be substituted “student”;

(ii)in paragraph 64(2)(7), for the words from “as a result of” to the end of the sub-paragraph, there shall be substituted “as a result of the student’s attendance on the course where an amount in respect of those expenses has already been disregarded pursuant to regulation 66(1) (student’s income to be disregarded).”.

Explanatory Note

(This note is not part of the Regulations.)

These Regulations amend the Income Support (General) Regulations (Northern Ireland) 1987 so as to change certain references in those Regulations to “full-time students” to references to “students”.

These Regulations make in relation to Northern Ireland only provision corresponding to provision contained in Regulations made by the Secretary of State for Social Security in relation to Great Britain and accordingly, by virtue of section 149(3) of, and paragraph 10 of Schedule 5 to, the Social Security Administration (Northern Ireland) Act 1992 (c. 8), are not subject to the requirement of section 149(2) of that Act for prior reference to the Social Security Advisory Committee.

These Regulations do not impose any charge on business.
