Motor Vehicles (Construction and Use) (Amendment No. 3) Regulations (Northern Ireland) 2001

The Department of the Environment, in exercise of the powers conferred on it by Articles 55(1), (2) and (6) and 110(2) of the Road Traffic (Northern Ireland) Order 1995(1) and of every other power enabling it in that behalf, hereby makes the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the Motor Vehicles (Construction and Use) (Amendment No. 3) Regulations (Northern Ireland) 2001 and shall come into operation on 1st October 2001.

Amendment of the Motor Vehicles (Construction and Use) Regulations (Northern Ireland) 1999

2.—(1) Schedule 10 to the Motor Vehicles (Construction and Use) Regulations (Northern Ireland) 1999(2) (emissions from certain motor vehicles) shall be amended in accordance with paragraphs (2) to (4).

(2) In paragraph 7, for sub-paragraph (b) there shall be substituted the following sub-paragraph—

(b)“the emissions publication” is the publication entitled “In-Service Exhaust Emission Standards for Road Vehicles seventh edition” (ISBN 0-9526457-6-9) published by the Department of the Environment, Transport and the Regions..

(3) In paragraph 8, for the words “free acceleration” there shall be substituted the words “when tested in accordance with point 8.2.2 of Annex II of the Council Directive 96/96/EC(3) as replaced with Article 1 of Commission Directive 1999/52/EC(4).”.

(4) In paragraph 9, in sub-paragraph (a) the word “and” shall be deleted and sub-paragraph (b) shall be deleted.

Explanatory Note

(This note is not part of the Regulations.)

These Regulations amend the definition of “the emissions publication” in Schedule 10 to the Motor Vehicles (Construction and Use) Regulations (Northern Ireland) 1999 (“the 1999 Regulations”) so as to refer to the most recent (i.e. the seventh) edition of the publication entitled “In-Service Exhaust Emission Standards for Road Vehicles”. The publication specifies, with respect to vehicles with spark ignition engines, the maximum permitted carbon monoxide content of exhaust emissions at idling speed and the limits for the ratio of air to petrol vapour entering the combustion chamber, in relation to each of the vehicle models named in the publication.

Copies of the emissions publication can be obtained from the Vehicle Inspectorate, Berkeley House, Croydon Street, Bristol, BS5 0DA (Telephone number 0117 954 3277).

The Regulations also insert a condition in paragraph 8 of Schedule 10 to the 1999 Regulations viz testing in accordance with point 8.2.2 of Annex 2 of the Council Directive 96/96/EC (O.J. No. L46, 17.02.97, p. 1) as replaced with Article 1 of Commission Directive 1999/52/EC (O.J. No. L142, 05.05.99, p. 26).

These Regulations have been notified to the European Commission pursuant to European Parliament and Council Directive 98/34/EC of 22nd June 1998 laying down a procedure for the provision of information in the field of technical standards and regulations (O.J. No. L204, 21.7.98, p. 37).
