HEALTH AND PERSONAL SOCIAL SERVICES

The Health and Personal Social Services (2001 Act) (Commencement No. 2) Order (Northern Ireland) 2001

The Department of Health, Social Services and Public Safety(1), in exercise of the powers conferred on it by section 61(2) of the Health and Personal Social Services Act (Northern Ireland) 2001(2) and of all other powers enabling it in that behalf, hereby makes the following Order:

Citation and Interpretation

1.—(1) This Order may be cited as the Health and Personal Social Services (2001 Act) (Commencement No. 2) Order (Northern Ireland) 2001.

(2) In this Order:

“the Act” means the Health and Personal Social Services Act (Northern Ireland) 2001;

“the Council” means the Northern Ireland Social Care Council;

“the Department” means the Department of Health, Social Services and Public Safety.

Appointed days

2.—(1) 1st October 2001 is the day appointed for the coming into operation of the following provisions of the Act:

(a)sections 1(2) (duty of the Council), 14 (functions of the Department), 17 (cesser of the functions of the Central Council for Education and Training in Social Work) and 19 (default powers of the Department); and

(b)for the purpose only of the exercise of any power of the Council to make rules, sections 4 and 5.

(2) The day appointed for the coming into operation of section 54(3) of the Act (public access to meetings of the Mental Health Commission) is 1st November 2001.

Explanatory Note

(This note is not part of the Order.)

This Order brings into operation on two dates certain provisions of the Health and Personal Social Services Act (Northern Ireland) 2001 (“the Act”).

Article 2(1) of the Order brings into operation the provisions of Part I of the Act relating to social care workers, as follows:

(a)sections 1(2) (the duty of the Council) on 1st October 2001;

(b)for the purpose only of the exercise of any power to make rules, sections 4 and 5 on 1st October 2001.

(c)sections 14 (functions of the Department), 17 (cessation of the functions of CCETSW) and 19 (default powers of the Department) on 1st October 2001.

Article 2(2) of the Order brings Section 54(3) (public access to meetings of the Mental Health Commission) into operation on 1st November 2001.

The following provisions of the Health and Personal Social Services Act (Northern Ireland) 2001 were brought into operation by the Health and Personal Social Services (2001 Act) (Commencement No. 1) Order (Northern Ireland) 2001 (C. 5) on the following dates:
