SOCIAL SECURITY

The Department for Social Development, in exercise of the powers conferred on it by section 17(1) of the Social Security Fraud Act (Northern Ireland) 2001(1) and of all other powers enabling it in that behalf, hereby makes the following Order:
1.—(1) This Order may be cited as the Social Security Fraud (2001 Act) (Commencement No. 5) Order (Northern Ireland) 2002.
(2) In this Order “the Act” means the Social Security Fraud Act (Northern Ireland) 2001.
2.—(1) The day appointed for the coming into operation of section 1(4) and (9) of the Act (additional powers to obtain information)–
(a)for the purpose only of authorising the making of an order, is 23rd December 2002; and
(b)for all other purposes, is 24th February 2003.
(2) The day appointed for the coming into operation of–
(a)section 1(1) to (3) and (5) to (8) of the Act;
(b)section 2 of the Act (electronic access to information);
(c)section 4 of the Act (arrangements for payments in respect of information); and
(d)the Schedule to the Act (repeals), and section 16 of the Act in so far as it relates to that Schedule, in so far as not already in operation,
is 24th February 2003.

This Order provides for the coming into operation of provisions of the Social Security Fraud Act (Northern Ireland) 2001. Section 1(4) and (9) (which provides additional powers to obtain information) is commenced for the purpose of authorising the making of an order on 23rd December 2002 and for all other purposes on 24th February 2003. The following provisions are commenced from 24th February 2003–
section 1(1) to (3) and (5) to (8);
section 2 which provides for electronic access to information;
section 4 which provides for arrangements for payments in respect of information; and
section 16 and the Schedule which provide for consequential repeals, in so far as not already in operation.
This Order does not impose a charge on business.
