ROAD TRAFFIC AND VEHICLES

The Department of the Environment, in exercise of the powers conferred on it by Articles 61(6), 62 and 110(2) of the Road Traffic (Northern Ireland) Order 1995(1) and of every other power enabling it in that behalf, hereby makes the following Regulations:
1. These Regulations may be cited as the Motor Vehicle Testing (Amendment) (Fees) Regulations (Northern Ireland) 2002 and shall come into operation on 1st April 2002.
2. In Schedule 1 to the Motor Vehicle Testing Regulations (Northern Ireland) 1995(2) for for paragraphs 1 to 3 there shall be substituted—
“1. Fee payable for examination under regulation 7(2) or 10(3) or 15(1)
(a)Vehicle in Class I or II | £17·50 |
(b)Vehicle in Class III or IV | £25·00 |
(c)Vehicle in Class V | £35·50 |
(d)Vehicle in Class VA— | |
(i)with 13 to 16 seats exclusive of driver | £47·00 |
(ii)with 17 to 35 seats exclusive of driver | £58·00 |
(iii)with more than 35 seats exclusive of driver | £72·50 |
(e)Vehicle in Class VI | £35·50 |
(f)Vehicle in Class VIA | £47·00 |
2. Fee payable for re-examination under regulation 10(4)
(a)Vehicle in Class I or II | £12·00 |
(b)Vehicle in Class III or IV | £16·00 |
(c)Vehicle in Class V | £18·50 |
(d)Vehicle in Class VA— | |
(i)with 13 to 16 seats exclusive of driver | £18·50 |
(ii)with 17 to 35 seats exclusive of driver | £18·50 |
(iii)with more than 35 seats exclusive of driver | £18·50 |
(e)Vehicle in Class VI | £18·50 |
(f)Vehicle in Class VIA | £18·50 |
3. Fee payable for re-examination under regulation 10(5)
(a)Vehicle in Class VA— | |
(i)with 13 to 16 seats exclusive of driver | £18·50 |
(ii)with 17 to 35 seats exclusive of driver | £30·00 |
(iii)with more than 35 seats exclusive of driver | £41·00 |
(b)Vehicle in Class VIA | £18·50.” |

These Regulations amend the Motor Vehicle Testing Regulations (Northern Ireland) 1995 by increasing the fees payable for examinations and re-examinations as follows—
(1) Examinations under regulations 7(2), 10(3) and 15(1)—
(a)for vehicles in Classes I or II, from £12·00 to £17·50;
(b)for vehicles in Classes III or IV, from £18·50 to £25·00;
(c)for vehicles in Class V, from £24·00 to £35·50;
(d)for vehicles in Class VA—
(i)with 13 to 16 seats, exclusive of the driver, from £34·00 to £47·00;
(ii)with 17 to 35 seats, exclusive of the driver, from £43·00 to £58·00;
(iii)with more than 35 seats, exclusive of the driver, from £52.50 to £72·50;
(e)for vehicles in Class VI, from £24·00 to £35·50; and
(f)for vehicles in Class VIA, from £34·00 to £47·00.
(2) Re-examination made within 21 days of the issue of the notice of refusal under regulation 10(4)—
(a)for vehicles in Class I or II, from £8·50 to £12·00;
(b)for vehicles in Class III or IV, from £10·50 to £16·00; and
(c)for vehicles of all other Classes, from £13·50 to £18·50.
(3) Re-examination under regulation 10(5)—
(a)for vehicles in Class VA—
(i)with 13 to 16 seats, exclusive of the driver, from £13·50 to £18·50;
(ii)with 17 to 35 seats, exclusive of the driver, from £23·00 to £30·00;
(iii)with more than 35 seats, exclusive of the driver, from £32·50 to £41·00;
(b)for vehicles in Class VIA, from £13·50 to £18·50.
