In exercise of the powers conferred on me by sections 74(1) and (2) and 75 of the Police (Northern Ireland) Act 1998(1), I hereby make the following Order: –
1. This Order may be cited as the Police (Northern Ireland) Act 1998 (Commencement No. 5) Order (Northern Ireland) 2003.
2. In this Order, “the Act” means the Police (Northern Ireland) Act 1998.
3. The following provisions of the Act shall come into operation on 21st February 2003 –
Section 76(2),
Schedule 4, paragraphs 4, 8, 9, 20(3) to (5), 21 and 22(8),
Part II of Schedule 5.

This Commencement Order, which is the fifth to be made under the Police (Northern Ireland) Act 1998, brings into force on 21st February 2003 Section 76(2), Schedule 4; paragraphs 4, 8, 9, 20(3) to (5), 21 and 22(8), and Part II of Schedule 5 to, the Police (Northern Ireland) Act 1998 (“the Act”).
Section 76(2) relates to arrangements with police forces in Great Britain where members of those forces are engaged on temporary service with the Police Ombudsman.
Schedule 4, paragraphs 4, 8, 9, 20(3)-(5), 21 and 22(8) amends where appropriate the Police (Scotland) Act 1967 (c. 77); House of Commons Disqualification Act 1975 (c. 24); Northern Ireland Assembly Disqualification Act 1975 (c. 25); Police Act 1996 (c. 16); Juries (Northern Ireland) Order (N.I. 6) and Police Act 1997 (c. 50) to include reference to, inter alia, the Police Ombudsman for Northern Ireland.
Part II of Schedule 5 relates to the transitional arrangements between the incoming Police Ombudsman and the outgoing Independent Commission for Police Complaints.
