Statutory Rules of Northern Ireland

The Department of Agriculture and Rural Development, being a Department designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to the common agricultural policy of the European Community, in exercise of the powers conferred on it by the said section 2(2) and of every other power enabling it in that behalf, hereby makes the following Regulations:
1. These Regulations may be cited as the Slaughter Premium (Amendment) Regulations (Northern Ireland) 2003 and shall come into operation on 5th May 2003.
2.—(1) In these Regulations, “the principal Regulations” means the Slaughter Premium Regulations (Northern Ireland) 2001(3).
(2) The Interpretation Act (Northern Ireland) 1954(4) shall apply to these Regulations as it applies to an Act of the Northern Ireland Assembly.
3.—(1) The principal Regulations shall be amended in accordance with paragraphs (2) to (5).
(2) In regulation 2(2) (interpretation) –
(a)for the definition of “Commission Regulation 2342/1999” there shall be substituted the following definition –
““Commission Regulation 2342/1999” means Commission Regulation (EC) No. 2342/1999 laying down detailed rules for the application of Council Regulation (EC) No. 1254/1999 on the common organisation of the market in beef and veal as regards premium schemes(5) (as amended by Commission Regulation (EC) No. 1042/2000(6), Commission Regulation (EC) No. 1900/2000(7), Commission Regulation (EC) No. 2733/2000(8), Commission Regulation (EC) No. 192/2001(9), Commission Regulation (EC) No. 1458/2001(10), Commission Regulation (EC) No. 2088/2001(11) Commission Regulation (EC) No. 169/2002(12), Commission Regulation (EC) No. 1830/2002(13) and Commission Regulation (EC) No. 2381/2002(14));”;
(b)for the definition of “Council Regulation 1254/1999” there shall be substituted the following definition –
““Council Regulation 1254/1999” means Council Regulation (EC) No. 1254/1999 on the common organisation of the market in beef and veal(15) (as amended by Council Regulation (EC) No. 1455/2001(16), Council Regulation (EC) No. 1512/2001(17) and Council Regulation (EC) No. 2345/2001(18));”;
(c)in the definition of “premium adult animal” the words “, other than a premium older animal” shall be deleted;
(d)for the definition of “premium animal” there shall be substituted the following definition –
“premium animal” means a premium adult animal and a premium calf;”; and
the definition of “premium older animal” shall be deleted.
(3) In regulation 2(4) for the words “these Regulations” there shall be substituted the words “the Slaughter Premium (Amendment) Regulations (Northern Ireland) 2003”.
(4) In regulation 8 –
(a)in paragraph (5)(b), the word “and” shall be omitted; and
(b)after paragraph (5)(c) there shall be added the following sub-paragraphs –
“(d)regulation 7 of the Beef Special Premium Regulations (Northern Ireland) 2001(19); and
(e)regulation 5 of the Suckler Cow Premium Regulations (Northern Ireland) 2001(20).”.
(5) In regulation 9 –
(a)in paragraph (3)(b) the word “and” shall be omitted; and
(b)after paragraph (3)(c) there shall be added the following sub-paragraphs –
“(d)regulation 8 of the Beef Special Premium Regulations (Northern Ireland) 2001; and
(e)regulation 6 of the Suckler Cow Premium Regulations (Northern Ireland) 2001.”.

These Regulations amend the Slaughter Premium Regulations (Northern Ireland) 2001 (“the 2001 Regulations”) which lay down implementing measures for the slaughter premium scheme for bovine animals introduced by Article 11 of Council Regulation (EC) No. 1254/1999 on the common organisation of the market in beef and veal.
The Regulations –
(a)update references in the 2001 Regulations to Community and domestic legislation (regulation 3(2)(a) and (b), (4) and (5)); and
(b)remove the distinction between “premium adult animal” and “premium older animal” (regulation 3(2)(c) to (e)).
