The Department for Employment and Learning(1), in exercise of the powers conferred by Articles 50(1) and (2) and 134(1)(2) of the Education and Libraries (Northern Ireland) Order 1986(3) and now vested in it(4) and of every other power enabling it in that behalf, hereby makes the following Regulations:
1. These Regulations may be cited as the Students Awards (Amendment) Regulations (Northern Ireland) 2004 and shall come into operation on 1st November 2004 and shall have effect on and from 1st September 2004.

2. In these Regulations, “the principal Regulations” means the Students Awards Regulations (Northern Ireland) 2003(5).

3. The principal Regulations shall be amended as provided by regulations 4 to 7.

4. In regulation 2 –
(a)for “Swiss Agreement” there shall be substituted “Switzerland Agreement”;
(b)after the definition of “Metropolitan Police District” there shall be inserted –
““new academic term” means any academic term beginning on or after 1st September 2004;
“new payment” means a payment made under these Regulations as amended by the Students Awards (Amendment) Regulations (Northern Ireland) 2004;
“old payment” means a payment which would have been made under these Regulations if they had not been amended by the Students Awards (Amendment) (Northern Ireland) Regulations 2004.”

5. In regulation 18 –
(a)for paragraph (3) there shall be substituted –
“(3) The payment to be made in relation to any new academic term shall be a new payment, and the payment in relation to any other academic term shall be an old payment, and a payment in relation to any year shall be calculated accordingly.”;
(b)paragraph (4) shall be omitted.

6. For paragraph (iv) of Schedule 5, there shall be substituted –
“(iv)in the case of a course at the University of Buckingham, four instalments of £676, in the case of a course at the Guildhall School of Music, a first and second instalment of £1,383 and a third instalment of £1,384; and in the case of a course at Heythrop College, a first and second instalment of £682 and a third instalment of £681.”

These Regulations which come into operation on 1st November 2004 have effect on and from 1st September 2004 amend the Students Awards Regulations (Northern Ireland) 2003 (“the principal Regulations”).
Retrospection is authorised by Article 50(2) of the Education and Libraries (Northern Ireland) Order 1986.
Regulation 4(a) changes “Swiss Agreement” to “Switzerland Agreement”. This is to ensure consistency throughout the principal Regulations. Regulation 4(b) inserts three new definitions.
Regulation 5 provides that the new payment rates prescribed in the Schedule to these Regulations shall only apply in relation to an academic term which commences on or after the 1st September 2004. Where an academic year starts before 1st September 2004, but ends after 1st September 2004, the old payment rates and the new payment rates shall be applied proportionally.
Regulation 6 specifies changes to the rates of fee awards in relation to courses at the University of Buckingham, the Guildhall School of Music and Heythrop College. Changes in relation to other fees and grants are provided for by regulation 7 and are specified in the Schedule to these Regulations.
