ENVIRONMENTAL PROTECTION

The Department of the Environment, in exercise of the powers conferred on it by section 40(2)(d) and (5) of the Waste and Emissions Trading Act 2003(1) and of all other powers enabling it in that behalf, hereby makes the following Order:
1.—(1) This Order may be cited as the Waste and Emissions Trading Act 2003 (Commencement No. 1) Order (Northern Ireland) 2004.
(2) In this Order any reference to a numbered section is to the section of the Waste and Emissions Trading Act 2003 bearing that number.
2.—(1) The day appointed for the coming into operation of –
(a)section 4 (Allocation of landfill allowances);
(b)section 5 (Alteration of allocations under section 4);
(c)section 9 (Duty not to exceed allowances); and
(d)section 10 (Monitoring authorities),
is 17th September 2004.
(2) The day appointed for the coming into operation of section 20 (Strategy for Northern Ireland), is 17th September 2004.

This Order appoints 17th September 2004 as the day for the coming into operation of sections 4, 5, 9 and 10 of the Waste and Emissions Trading Act 2003 (“the 2003 Act”) in relation to Northern Ireland.
This Order also appoints 17th September 2004 as the day for the coming into operation of section 20 of the 2003 Act.
A full Regulatory Impact Assessment has not been prepared for this Order as it has no impact on costs to business.
