1. These Regulations may be cited as the General Teaching Council for Northern Ireland (Deduction of Fees) Regulations (Northern Ireland) 2004 and shall come into operation on 1st November 2004.
2. In these Regulations, “fee” means any fee payable under regulation 9 of the General Teaching Council for Northern Ireland (Registration of Teachers) Regulations (Northern Ireland) 2004(1).
3.—(1) In the case of a fee in respect of the period from the coming into operation of these Regulations until 31st March 2005, the issuing authority shall secure that the fee is deducted from the payment of salary made to the teacher immediately following the date notified to that issuing authority by the Council.
(2) This regulation applies to a teacher who is required as a consequence of his employment to be registered in the Register by virtue of the General Teaching Council for Northern Ireland (Registration of Teachers) Regulations (Northern Ireland) 2004 and who has not already paid the fee in respect of the period referred to in paragraph (1).
4.—(1) In the case of a fee in respect of the year commencing on 1st April 2005 and ending on 31st March 2006, and each such subsequent year, the issuing authority shall secure that the fee is deducted from the payment of salary made to the teacher immediately following the date notified to that issuing authority by the Council.
(2) This regulation applies to a teacher who is required as a consequence of his employment to be registered in the Register by virtue of the General Teaching Council for Northern Ireland (Registration of Teachers) Regulations (Northern Ireland) 2004 and who has not already paid the fee in respect of any period referred to in paragraph (1).
5. The issuing authority shall within 14 days of the fee being deducted in accordance with regulation 3 or 4 remit such fee to the Council.
6. When remitting the fee in relation to a teacher, the issuing authority shall notify the Council of the details of that teacher specified in the Schedule.
7. Failure by any person to discharge any duty within a time limit specified in these Regulations does not relieve that person of that duty.
