Independent investigation of relevant complaints
18.—(1) An investigation or decision by the Board in accordance with regulation 2 must not be made by any person concerned in the matter which is the subject of the relevant complaint.
(2) Where the Board establishes a committee for the purposes of Article 190(3)(b) and regulation 10, paragraph 15 of Schedule 5 to the Pensions Act 2004(1) (the Board of the Pension Protection Fund: committees) shall apply as if after sub-paragraph (5) there were inserted the following sub-paragraph –
“(6) A committee (or any sub-committee established by the committee under sub-paragraph (2)) established by the Board for the purposes of Article 190(3)(b) of the Pensions (Northern Ireland) Order 2005 and any regulations made under that Article must not include any person concerned in the matter which is the subject of the relevant complaint.”.
