REGISTRATION OF BIRTHS, DEATHS, MARRIAGES AND CIVIL PARTNERSHIPS

The Department of Finance and Personnel, in exercise of the powers conferred on it by Article 47(1) and (2) of the Births and Deaths Registration (Northern Ireland) Order 1976(1), Articles 3(3)(b), 19(1)(a), 35(3), 36(1)(b) and (3) and 37 of the Marriage (Northern Ireland) Order 2003(2), and Section 157(1) of the Civil Partnership Act 2004(3) and of all other powers enabling it in that behalf, hereby makes the following Regulations:

Citation, commencement and interpretation

1.—(1) This order may be cited as the Births, Deaths, Marriages and Civil Partnerships (Fees) Order (Northern Ireland) 2005 and shall come into operation on 5th December 2005.

(2) The Interpretation Act (Northern Ireland) 1954(4) shall apply to this Order as it applies to an Act of the Assembly.

Fees payable

2.  The fee payable under a statutory provision specified in column 1 of the Schedule in respect of the matter specified in relation to it in column 2 shall be the fee specified in relation to it in column 3.

Revocation

3.  The Births, Deaths and Marriages (Fees) Order (Northern Ireland) 2003(5) is hereby revoked.

Explanatory Note

(This note is not part of the Order)

This Order provides for the increase of various fees payable under the Births and Deaths Registration (Northern Ireland) Order 1976 relating to the registration of births and deaths. It also provides for the increase of various fees payable under the Marriage (Northern Ireland) Order 2003 relating to giving notice for intended marriage, the solemnisation of civil marriage and providing marriage certificates. It also provides for the various new fees payable under the Civil Partnership Act 2004 relating to giving notice for intended civil partnership, the registration of civil partnership and providing civil partnership certificates.

This Order revokes and replaces the Births, Deaths and Marriages (Fees) Order (Northern Ireland) 2003.
