The Department of Agriculture and Rural Development(1), in exercise of the powers conferred by section 1 of the Seeds Act (Northern Ireland) 1965(2), after consultation with representatives of such interests as appear to it to be concerned, makes the following Regulations:

Citation, commencement and interpretationN.I.

1.—(1) These Regulations may be cited as The Seed Potatoes (Tuber Inspection Fees) Regulations (Northern Ireland) 2006 and shall come into operation on 28th August 2006.

(2) In these Regulations:

“official label” shall have the meaning assigned to it in regulation 2 of the Seed Potatoes Regulations (Northern Ireland) [F22010] ;

“the Seed Potatoes Regulations” refers to the Seed Potatoes Regulations (Northern Ireland) [F22010] .

2.  The following are revoked—

(a)The Seed Potatoes (Tuber and Label Fees) Regulations (Northern Ireland) 1982(3); and

(b)The Seed Potatoes (Tuber and Label Fees) (Amendment) Regulations (Northern Ireland) 2005(4).

3.  There shall be paid in respect of matters arising under the Seed Potatoes Regulations:

(a)on demand, fees referred to at 1 in the Schedule;

(i)from the person exporting seed potatoes as [F3indicated] on the package or container in accordance with [F4regulation 13(2)] and Schedule 5, Part II of the Seed Potatoes Regulations when seed potatoes are intended for export from Northern Ireland; or

(ii)from the person requesting the inspection when the potatoes are not intended for export from Northern Ireland; or

(b)in advance, by the person, to [F5whom] the official labels F6..., are supplied.

4.  The fees as specified in regulation 3 shall be payable to the Department.

5.  Where the fees for tuber inspection and labels were separate in previous Regulations, these have now been combined, as per the Schedule.

ExemptionsN.I.

6.  The Department may exempt any class of person or persons generally from compliance in whole or in part with the provisions of these Regulations; in relation to payment of fees any exemptions so made may be subject to conditions.

MatterFee

1.  Fee for the inspection of seed potato tubers prior to their being sealed under [F7regulation 17 of the Seed Potatoes Regulations (Northern Ireland) 2010] and for the provision of an appropriate number of labels for packages per tonne

£4.40 per tonne or part of a tonne

Explanatory Note

(This note is not part of the Regulations)

These Regulations revoke the Seed Potatoes (Tuber and Label Fees) Regulations (Northern Ireland) 1982 (S.R. 1982/236) and the Seed Potatoes (Tuber and Label Fees) (Amendment) Regulations (Northern Ireland) 2005 (S.R. 2005/370).

These Regulations—

(a)increase the tuber inspection fee from £3.90 per tonne to £4.40 per tonne or part therefore (regulation 3 and Schedule);

(b)include the former label fees within the charge for the tuber inspections (regulation 5 and Schedule); and

(c)provide for exemptions for classes of person or persons generally in relation to the payment of fees. The Department will notify the seed potato industry when such exemptions are to be granted (regulation 6).
