The Department of Health, Social Services and Public Safety makes the following Order in exercise of the powers conferred by section 7(4) and (5) of the Misuse of Drugs Act 1971(1), as adapted by section 7(9) of the Act and now vested in it (2) and after consultation with the Advisory Council on the Misuse of Drugs in accordance with section 7(7) of that Act.
1. This Order may be cited as the Misuse of Drugs (Designation) (Amendment No.2) Order (Northern Ireland) 2010 and shall come into operation on 23rd July 2010.
2.—(1) In this order “the 2001 Order” means the Misuse of Drugs (Designation) Order (Northern Ireland) 2001 (3).
(2) The Interpretation Act (Northern Ireland) 1954(4) shall apply to this Order as it applies to an Act of the Assembly.
3. In Part 1 of the Schedule to the 2001 Order after paragraph 1(q), insert—
“(r)Any compound structurally derived from 2–aminopropan-1-one by substitution at the 1-position with any monocyclic, or fused polycyclic ring system (not being a phenyl ring or alkylenedioxyphenyl ring system), whether or not the compound is further modified in any of the following ways, that is to say,
(i)by substitution in the ring system to any extent with alkyl, alkoxy, haloalkyl or halide substituents, whether or not further substituted in the ring system by one or more other univalent substituents;
(ii)by substitution at the 3–position with an alkyl substituent;
(iii)by substitution at the 2‑amino nitrogen atom with alkyl or dialkyl groups, or by inclusion of the 2‑amino nitrogen atom in a cyclic structure.”.

Section 7(3) of the Misuse of Drugs Act 1971 requires regulations to be made to allow the use for medical purposes of the drugs which are subject to control under that Act. Section 7(3) does not apply to any drug designated by order under section 7(4) as a drug to which section 7(4) is to apply. This Order amends the Misuse of Drugs (Designation) Order (Northern Ireland) 2001 by inserting into Part 1 of the Schedule to that Order a further group of cathinone derivatives (including naphthylpyrovalerone, commonly known as naphyrone).
