The Department of the Environment, being a Department(1) designated for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to the environment, acting in exercise of the powers conferred upon it by that section, makes the following Regulations:

Citation, commencement and interpretationN.I.

1.—(1) These Regulations may be cited as the Environmental Liability (Prevention and Remediation) (Amendment) Regulations (Northern Ireland) 2011 and come into operation on 25th June 2011.

(2) The Interpretation Act (Northern Ireland) 1954(3) applies to these Regulations as it applies to an Act of the Assembly.

Amendment of the Environmental Liability (Prevention and Remediation) Regulations (Northern Ireland) 2009N.I.

2.—(1) The Environmental Liability (Prevention and Remediation) Regulations (Northern Ireland) 2009(4) are amended as follows.

(2) In Schedule 2, after paragraph 9 insert—

Geological storage of carbon dioxide

10.  The operation of storage sites pursuant to Directive 2009/31/EC of the European Parliament and of the Council of 23 April 2009 on the geological storage of carbon dioxide..

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Environmental Liability (Prevention and Remediation) Regulations (Northern Ireland) 2009 which implement Directive 2004/35/EC of the European Parliament and of the Council on environmental liability with regard to the prevention and remedying of environmental damage (“the Environmental Liability Directive”). The Regulations make provision for implementing an amendment to the Environmental Liability Directive by Article 34 of Directive 2009/31/EC of the European Parliament and of the Council of 23 April 2009 on the geological storage of carbon dioxide.
