The Department for Employment and Learning(1) makes the following Regulations in exercise of the powers conferred on it by Articles 70(1) and (2)(2) and 134(3) of the Education and Libraries (Northern Ireland) Order 1986, and now vested in it(4):

Citation and commencement

1.  These Regulations may be cited as the Further Education Teachers’ (Eligibility) (Amendment) Regulations (Northern Ireland) 2011 and shall come into operation on 1st December 2011.

Amendment of the Further Education Teachers’ (Eligibility) Regulations (Northern Ireland) 2007

2.—(1) The Further Education Teachers’ (Eligibility) Regulations (Northern Ireland) 2007(5) shall be amended as provided by paragraphs (2) to (4).

(2) In regulation 3 (Interpretation) the definitions of “medical practitioner” and “qualified teacher” shall be omitted.

(3) In regulation 6 (Health Requirements), paragraphs (2), (4), (5) and (6) shall be revoked.

(4) Regulation 7 (Employment of Unqualified Teachers) shall be revoked.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Further Education Teachers’ (Eligibility) Regulations (Northern Ireland) 2007 (“the 2007 Regulations”).

Regulation 2(2) removes the definitions of “medical practitioner” and “qualified teacher”.

Regulation 2(3) removes the prescriptive nature of what actions a governing body may take in ensuring that a person may not be employed, or continue to be employed, as a teacher where he no longer satisfies the health requirements.

Regulation 2(4) removes the provision for a person who is not a qualified teacher to be temporarily employed where a governing body is unable to secure the services of a qualified teacher.
