The Mental Health (1986 Order) (Commencement No. 5) Order (Northern Ireland) 2012

The Department of Health, Social Services and Public Safety(1), makes the following Order in exercise of the powers conferred by Article 1(2) of the Mental Health (Northern Ireland) Order 1986(2).

Citation and interpretation

1.—(1) This Order may be cited as the Mental Health (1986 Order) (Commencement No. 5) Order (Northern Ireland) 2012.

(2) In this Order “the Order” means the Mental Health (Northern Ireland) Order 1986.

Appointed days

2.—(1) 1st November 2012 is the day appointed for the coming into operation of the following provisions of the Order, insofar as they confer power to make Regulations –

(a)Article 91 (Application for, and grant of, certificate of registration); and

(b)Article 95 (Application of this Order to private hospitals).

(2) 31st March 2013 is the day appointed for the coming into operation of the following provisions of the Order, insofar as they are not already in operation –

(a)Article 90 (Registration of private hospitals);

(b)Article 91 (Application for, and grant of, certificate of registration);

(c)Article 92 (Certificates of registration);

(d)Article 93 (Control of private hospitals);

(e)Article 94 (Cancellation of registration);

(f)Article 95 (Application of the Order to private hospitals); and

(g)Article 96 (Offences under Part VII).

(This note is not part of the Order)

This Commencement Order brings into operation the last remaining part, Part VII (Registration of Private Hospitals), of the Mental Health (Northern Ireland) Order 1986.
