Public Passenger Transport

The Department for Regional Development makes the following Order in exercise of the powers conferred by section 48 of the Transport Act (Northern Ireland) 2011(1).
1.—(1) This Order may be cited as the Transport (2011Act) (Commencement No. 1) Order (Northern Ireland) 2013.
(2) In this Order—
“the Act” means the Transport Act (Northern Ireland) 2011.
2. The appointed day for the coming into operation of the following provisions of the Act is 22nd April 2013—
(a)section 2(1) and (3) (service agreements);
(b)section 15 (holding companies and subsidiaries);
(c)section 29 (exercise of enforcement powers authorised persons and constables);
(d)section 31(1) (prosecutions);
(e)section 32 (approved capital expenditure);
(f)section 33 (services for benefit of certain sections of the public);
(g)section 36 (supplementary);
(h)section 38 (acquisition of land by agreement or compulsorily);
(i)section 39 (disposal of land acquired under section 38);
(j)section 40 (powers to obtain information and enter land);
(k)section 42 (conduct of persons at bus stations);
(l)section 43 (shared transport facilities);
(m)section 44 (application of Act to partnerships);
(n)section 45 (regulations general);
(o)section 47(2) and Schedule 2 only insofar as they relate to the repeal of sections 11 and 75A of the Transport Act (Northern Ireland) 1967 and Article 6 of the Transport (Northern Ireland) Order 1977.

This is the first Commencement Order to be made under the Transport Act (Northern Ireland) 2011.
Article 2 brings into operation sections 2(1) and 2(3), 15, 29, 31(1), 32, 33, 36, 38, 39, 40, 42, 43, 44, 45 and partially 47(2) and schedule 2 of the Act.
