The Justice Act (Northern Ireland) 2015 (Single Jurisdiction) (Consequential Amendments and Revocations) Order (Northern Ireland) 2016

Coming into operation in accordance with Article 1.

The Department of Justice, in exercise of the powers conferred by section 6(2) and (3) of the Justice Act (Northern Ireland) 2015(1) makes the following Order.

PART 1INTRODUCTORY

Citation and commencement

1.  This Order may be cited as the Justice Act (Northern Ireland) 2015 (Single Jurisdiction) (Consequential Amendments and Revocations) Order (Northern Ireland) 2016 and shall come into operation on the same date as section 1 of the Justice Act (Northern Ireland) 2015 comes into operation.

PART 2CONSEQUENTIAL AMENDMENTS TO SUBORDINATE LEGISLATION

Amendment to the Juvenile Courts and Assessors for County Courts Regulations (Northern Ireland) 1979

2.—(1) The Juvenile Courts and Assessors for County Courts Regulations (Northern Ireland) 1979(2) are amended as follows.

(2) Omit regulation 3.

(3) In regulation 6—

(a)in paragraph (1), omit “for the county court division for which that county court is held”; and

(b)for paragraph (2), substitute —

(2) In this regulation “chief clerk” means an officer of the Department of Justice designated as such by that Department..

Amendment to the Gaming Machine (Forms of Certificates and Permit) Regulations (Northern Ireland) 1986

6.  In the Child Support (Collection and Enforcement) Regulations (Northern Ireland) 1992(6), in Schedules 1, 2 and 3, in the title, omit “Petty Sessions District of” and “County Court Division of”.

Amendment to the Juries Regulations (Northern Ireland) 1996

7.—(1) The Juries Regulations (Northern Ireland) 1996(7) are amended as follows.

(2) For regulation 4(2) to (4), substitute—

(2) The Divisional Jurors List for each division shall be divided into parts. Each part shall contain the names of those who reside in the wards specified in the corresponding part of the tables set out in Schedule 1A.

(3) The Divisional Jurors Lists divided into parts under paragraph (2) shall be arranged and numbered so that in each part the names of jurors appear chronologically in the order of the list sent to the Juries Officer in accordance with Article 4(3) of the Order.

(4) The wards referred to in this regulation are those wards constituted by the Local Government (Boundaries) Order (Northern Ireland) 2012(8)..

(3) After Schedule 1, insert Schedule 1A as set out in the Schedule.

Amendment to the Children (Allocation of Proceedings) Order (Northern Ireland) 1996

8.—(1) The Children (Allocation of Proceedings) Order (Northern Ireland) 1996(9) is amended as follows.

(2) In Article 1(2), omit the definition of “petty sessions districts”.

(3) In Article 2—

(a)in paragraph (a), for “for the petty sessions districts specified in Schedule 1”, substitute “so specified in directions issued by the Lord Chief Justice”; and

(b)in paragraph (b), for “specified in Schedule 2”, substitute “so specified in directions issued by the Lord Chief Justice” .

(4) Omit Article 15.

(5) Omit Schedule 1.

(6) Omit Schedule 2.

Amendment to the Registration of Clubs (Form of Children’s Certificate) Regulations (Northern Ireland) 1997

15.—(1) The Road Traffic Fixed Penalties (Enforcement of Fines) Regulations (Northern Ireland) 1997(16) are amended as follows.

(2) In regulation 2, omit the definitions of “county court division” and “petty sessions district”.

(3) In regulation 3(2)(a), omit “for that petty sessions district”.

(4) In regulation 4, for paragraph (2), substitute—

(2) A magistrates’ court may, upon complaint made by the clerk of petty sessions, at any time after the expiration of 14 days from the due date and before the expiration of 6 months from that date—

(a)issue and cause to be served on the defendant a summons for the appearance of the defendant before a court of summary jurisdiction; or

(b)by warrant cause the defendant to be brought before a court of summary jurisdiction..

(5) In regulation 4A(3), omit “for the petty sessions district in which the sum payable in default is registered”.

(6) In regulation 5(5), for the words from “a court acting” to the end, substitute “a court of summary jurisdiction”.

(7) In regulation 6(2), omit “for the petty sessions district in which the sum payable in default is registered”.

(8) In regulation 9, omit “for the petty sessions district in which a sum payable in default is registered”.

(9) In the Schedule, in paragraph (a), for “the court of summary jurisdiction acting for the petty sessions district of […]”, substitute “a court of summary jurisdiction”.

Amendment to the Family Homes and Domestic Violence (Allocation of Proceedings) Order (Northern Ireland) 1999

16.—(1) The Family Homes and Domestic Violence (Allocation of Proceedings) Order (Northern Ireland) 1999(17) is amended as follows.

(2) In Article 1, for the definition of “county court”, substitute ““family care centre” means a county court so specified in directions issued by the Lord Chief Justice;”.

(3) Omit Article 2.

(4) In Article 4(3), for “a divorce county court”, substitute “any other county court”.

(5) Omit Article 6.

(6) Omit Article 9.

(7) Omit Article 14.

Amendment to the Local Government Pension Scheme Regulations (Northern Ireland) 2000

17.  In the Local Government Pension Scheme Regulations (Northern Ireland) 2000(18), in regulation J10, omit from “having jurisdiction” to the end.

Amendment to the Fire Precautions (Workplace) Regulations (Northern Ireland) 2001

18.  In the Fire Precautions (Workplace) Regulations (Northern Ireland) 2001(19), omit regulation 14(4).

Amendment to the Declarations of Parentage (Allocation of Proceedings) Order (Northern Ireland) 2002

19.—(1) The Declarations of Parentage (Allocation of Proceedings) Order (Northern Ireland) 2002(20) is amended as follows.

(2) In Article 2, omit the definition of “petty sessions districts”.

(3) In Article 3—

(a)in paragraph (a), for “for the petty sessions districts specified in Schedule 1”, substitute “so specified in directions issued by the Lord Chief Justice”; and

Amendment to the Sea Fishing (Restriction on Days at Sea) Order (Northern Ireland) 2003

21.  In the Sea Fishing (Restriction on Days at Sea) Order (Northern Ireland) 2003(22), in Article 13(3), for the words from “specifies a petty sessions district” to the end, substitute “specifies that payment of the fine is enforceable in Northern Ireland, paragraphs (1) and (2) shall apply as if the fine were imposed by a court in Northern Ireland.”.

Amendment to the Zoos Licensing Regulations (Northern Ireland) 2003

22.  In the Zoos Licensing Regulations (Northern Ireland) 2003(23), in regulation 23(1), omit “acting for the petty sessions area in which the zoo is situated”.

Amendment to the Bookmaking (Forms of Licences) Regulations (Northern Ireland) 2004

23.—(1) The Bookmaking (Forms of Licences) Regulations (Northern Ireland) 2004(24) are amended as follows.

24.  In the Sea Fishing (Enforcement of Community Quota and Third Country Fishing Measures) Order (Northern Ireland) 2004(25), in Article 6(3), for the words from “in a petty sessions district” to the end, substitute “in Northern Ireland, paragraphs (1) and (2) shall apply as if the fine were imposed by a court in Northern Ireland.”.

26.  In the Sea Fishing (Enforcement of Community Satellite Monitoring Measures) (Northern Ireland) Order 2005(27), in Article 16(3), for the words from “in a petty sessions district” to the end, substitute “in Northern Ireland, paragraphs (1) and (2) shall apply as if the fine were imposed by a court in Northern Ireland.”.

Amendment to the Sea Fishing (Marking and Identification of Passive Fishing Gear and Beam Trawls) Order (Northern Ireland) 2008

28.  In the Sea Fishing (Marking and Identification of Passive Fishing Gear and Beam Trawls) Order (Northern Ireland) 2008(29), in Article 5(4), for the words from “specifies a petty sessions district” to the end, substitute “specifies that payment of the fine is enforceable in Northern Ireland, this Article shall apply as if the fine were imposed by a court in Northern Ireland.”.

Amendment to the Local Government Pension Scheme (Administration) Regulations (Northern Ireland) 2009

29.  In the Local Government Pension Scheme (Administration) Regulations (Northern Ireland) 2009(30), in regulation 59, omit from “having jurisdiction” to the end.

Amendment to the Tourist Establishments (Notices, Certificates and Forms) Regulations (Northern Ireland) 2011

30.  In the Tourist Establishments (Notices, Certificates and Forms) Regulations (Northern Ireland) 2011(31), in the Schedule, in the last paragraph of Forms 5, 6(a), 6(b), 6(c), 7 and 9, omit “division in which the establishment is situated”.

Amendment to the Civil Jurisdiction and Judgments (Maintenance) Regulations 2011

31.  In the Civil Jurisdiction and Judgments (Maintenance) Regulations 2011(32), in Schedule 1—

(a)in paragraph 1(3), for the words from “acting for” to the end, substitute “in Northern Ireland.”; and

(b)in paragraph 11(10)—

(i)for head (ea), substitute—

(ea)in sub-paragraph (2), there were omitted the words from “of the family court” to the end;;

(ii)for head (ga), substitute—

(ga)for sub-paragraph (7) there were substituted—

(7) If the clerk of petty sessions is unable to establish where the respondent is residing, the clerk shall return the application to the Department of Justice.;; and

(iii)after head (ga) insert—

(gb)sub-paragraph (8) were omitted; and.

Amendment to the Criminal Aid Certificates Rules (Northern Ireland) 2012

32.  In the Criminal Aid Certificates Rules (Northern Ireland) 2012(33), in the Schedule—

(a)in Forms A, B, C, D, E and H, in the title, omit “Petty Sessions District of ….” and “County Court Division of ….”; and

(b)in Form I, in the title, omit “County Court Division of ….”.

(2) In regulation 2, omit the definitions of “county court division” and “petty sessions district”.

(3) Omit regulation 3(2).

(4) For regulation 4(2), substitute—

(2) A magistrates’ court may, upon complaint made by the clerk of petty sessions, at any time after the expiration of 14 days from the due date and before the expiration of 6 months from that date—

(a)issue and cause to be served on the defendant a summons for the appearance of the defendant before a court of summary jurisdiction; or

(b)by warrant cause the defendant to be brought before a court of summary jurisdiction..

(5) In regulation 6(5), for the words from “a court acting” to the end, substitute “a court of summary jurisdiction”.

(6) In Schedule 1, in paragraph (a), for “the court of summary jurisdiction acting for the petty sessions district of ….”, substitute “a court of summary jurisdiction.”.

Amendment to the International Recovery of Maintenance (Hague Convention 2007 etc.) Regulations (Northern Ireland) 2012

34.—(1) The International Recovery of Maintenance (Hague Convention 2007 etc.) Regulations (Northern Ireland) 2012(35) are amended as follows.

(2) In Schedule 1—

(a)in paragraph 1(3), for “acting for the same petty sessions district as that court”, substitute “in Northern Ireland”; and

(b)in paragraph 7—

(i)in sub-paragraph (1), for “the clerk of a magistrates’ court acting for the petty sessions district in which the respondent is residing”, substitute “the clerk of petty sessions”;

(ii)in sub-paragraph (2), for “the clerk of that court”, substitute “the clerk of petty sessions”;

(iii)for sub-paragraph (6) substitute—

(6) If the clerk of petty sessions is unable to establish where the respondent is residing, the clerk shall return the application to the Department of Justice.; and

(iv)omit sub-paragraph (7).

(3) In paragraph 2(1) of Schedule 2, in the definition of “the creditor”, omit “of a petty sessions district”.

Amendment to the Local Government Pension Scheme Regulations (Northern Ireland) 2014

35.  In the Local Government Pension Scheme Regulations (Northern Ireland) 2014(36), in regulation 89, omit from “having jurisdiction” to the end.

Part 2 of the Order makes consequential amendments to the Orders and Regulations listed below to take account of Part 1 of and Schedule 1 to the Justice Act (Northern Ireland) 2015 (“the Act”) which abolished county court divisions and petty sessions districts in Northern Ireland, and created a single territorial jurisdiction for the county courts and magistrates’ courts, supported by an administrative framework:

  • The Juvenile Courts and Assessors for County Courts Regulations (Northern Ireland) 1979 (S.R. 1979 No. 104);

  • The Local Government Pension Scheme Regulations (Northern Ireland) 2014 (S.R. 2014 No. 188)

Part 3 lists the Orders which are revoked in consequence of Part 1 of the Act. In addition to the abolition of petty sessions districts and county court divisions by section 1 of the Act, divorce county courts and civil partnership proceedings county courts as distinct designations of county courts were also abolished by virtue of paragraphs 76 and 124 of Schedule 1 to the Act. Accordingly, the following Orders are revoked:

  • The Divorce County Courts Order (Northern Ireland) 1990 (S.R. 1990 No.198);

  • The Petty Sessions Districts Order (Northern Ireland) 1994 (S.R. 1994 No. 470);

  • The Civil Partnership Proceedings County Courts Order (Northern Ireland) 2005 (S.R. 2005 No. 499); and

  • The County Court Divisions Order (Northern Ireland) 2013 (S.R. 2013 No. 132).
