The Department of Justice (“the Department”) is designated for the purposes of section 2(2) of the European Communities Act 1972 (“the 1972 Act”) M1 in relation to the placing on the market, transfer and safety of explosives for civil use.
These Regulations make provision for a purpose mentioned in section 2(2) of the 1972 Act and it appears to the Department that it is expedient for certain references to provisions of the EU instruments to be construed as a reference to those provisions as amended from time to time.
The Department, being the Department concerned M2makes the following Regulations in exercise of the powers conferred by section 2(2) of, and paragraph 1A of Schedule 2 to, the 1972 Act M3 and Articles 17(1) to (6) M4 and 55(2) of, and paragraphs 1(1) and (4), 5 and 14(1) of Schedule 3 to, the Health and Safety at Work (Northern Ireland) Order 1978 (“the 1978 Order”) M5.
In accordance with Article 46(1) of the 1978 Order it has consulted with the Health and Safety Executive for Northern Ireland and such bodies as appeared to be appropriate.
