The Department for Infrastructure(1) makes the following Regulations in exercise of the powers conferred by Articles 66(1) and 218(1) of the Road Traffic (Northern Ireland) Order 1981(2) and now vested in it(3).

Citation and commencement

1.  These Regulations may be cited as the Public Service Vehicles (Amendment) Regulations (Northern Ireland) 2018 and shall come into operation on 20th May 2018.

Amendment of the Public Service Vehicles Regulations (Northern Ireland)

2.—(1) The Public Service Vehicles Regulations (Northern Ireland) 1985(4) are amended in accordance with paragraphs (2) and (3).

(2) In regulation 9 (re-inspection of vehicle)—

(a)in paragraph (3) after “appointed by the Department” insert “no later than 60 days from the date of notification of refusal”; and

(b)in paragraph (5) after “appointed by the Department” insert “no later than 60 days from the date of notification of refusal”.

(3) For Schedule 3 (items included in inspection) substitute the Schedule to these Regulations.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Public Service Vehicles Regulations (Northern Ireland) 1985 (“the 1985 Regulations”) to give effect to the requirements of Directive 2014/45/EU of the European Parliament and of the Council of 3rd April 2014 on the periodic roadworthiness tests for motor vehicles and their trailer.

These Regulations amend regulation 9 (re-inspection of vehicle) of the 1985 Regulations to prescribe a limit on the time for retesting follow an initial test failure.

These Regulations also amend Schedule 3 (items included in inspection) of the 1985 Regulations to include reference to front fog lamps, reversing lamps and daytime running lamps as items to be inspected.
