The Department for Infrastructure(1), makes the following Regulations in exercise of the powers conferred by sections 20 and 56(1) of the Taxis Act (Northern Ireland) 2008(2) and now vested in it(3).

Citation and commencement

1.  These Regulations may be cited as the Taxi Licensing (Amendment) Regulations (Northern Ireland) 2018 and shall come into operation on 20th May 2018.

Amendment of Taxi Licensing Regulations (Northern Ireland)

2.—(1) The Taxi Licensing Regulations (Northern Ireland) 2015(4) are amended in accordance with paragraphs (2) and (3).

(2) For regulation 9(1) (further application for a taxi licence) substitute—

Further application for a taxi licence within 21 days of refusal

9.(1) Where an applicant is notified in accordance with regulation 7(4), the applicant may make a further application for a taxi licence within 21 days from and including the date of notification.

(1A) Where a further application is made in accordance with paragraph (1) the taxi must be presented for a further inspection no later than 60 days from and including the date of notification on a date and at a time appointed by the Department..

(3) In the table in Schedule 2 (items included in inspection)—

(a)after item 4(5) “rear fog lamps” insert—

(5A) Front fog lights
(a) position
(b) condition and operation
(c) colour and visual efficiency; and

(b)after item 4(11) “end outline marker lamps” insert—

(12) Reversing lamps
(13) Daytime running lamps.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Taxi Licensing Regulations (Northern Ireland) 2015 (“the 2015 Regulations”) to give effect to the requirements of Directive 2014/45/EU of the European Parliament and of the Council of 3rd April 2014 on the periodic roadworthiness tests for motor vehicles and their trailers.

These Regulations amend regulation 9 (further application for a taxi licence) of the 2015 Regulations to prescribe a limit on the time allowed for retesting following an initial test failure.

They also amend Schedule 2 (item included in inspection) of the 2015 Regulations to include front fog lamps, reversing lamps and daytime running lamps as items to be inspected under regulation 4 (inspection of taxi) of the 2015 Regulations.
