The Department of Agriculture, Environment and Rural Affairs(1), being designated(2) for the purpose of section 2(2) of the European Communities Act 1972(3) in relation to the common agricultural policy of the European Union in exercise of the powers conferred under that section 2(2) of that Act, makes the following Regulations.

There has been open and transparent public consultation during the preparation of these Regulations as required by Article 9 of Regulation (EC) No. 178/2002 of the European Parliament and of the Council(4) laying down the general principles and requirements of food law, establishing the European Food Safety Authority and laying down procedures in matters of food safety.

PART 1Introductory

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Eggs and Chicks and Poultrymeat (Amendment) Regulations (Northern Ireland) 2019 and shall come into operation on 19th November 2019.

(2) The Interpretation Act (Northern Ireland) 1954(5) shall apply to these Regulations as it applies to an Act of the Northern Ireland Assembly.

PART 2Amendment of Agriculture (Food) Provisions

Amendment to the Eggs and Chicks Regulations (Northern Ireland) 2010

2.  In the Eggs and Chicks Regulations (Northern Ireland) 2010(6), after regulation 2(8), insert—

(9) Any reference in these Regulations to Part VI of Annex VII of Regulation (EU) 2013 includes a reference to the equivalent transitional marketing standards under Article 116 of and Annex XIV to, the Single CMO Regulation..

Amendment to the Poultrymeat Regulations (Northern Ireland) 2011

3.  In the Poultrymeat Regulations (Northern Ireland) 2011(7), after regulation 2(4), insert—

(5) Any reference in these Regulations to Part VI of Annex VII of Regulation (EU) 2013 includes a reference to the equivalent transitional marketing standards under Article 116 of and Annex XIV to, the Single CMO Regulation..

EXPLANATORY NOTE

(This note is not part of the Order)

These regulations update European Union legislative references.

Part 2 amends the Eggs and Chicks Regulations (Northern Ireland) 2010 and the Poultrymeat Regulations (Northern Ireland) 2011 to provide that any reference to a specified EU Regulation is to be construed so as to include a reference to another specified EU Regulation

Formerly the Department of Agriculture and Rural Development (DARD see Article 3(4) of the Departments (Northern Ireland) Order 1999 (S.I. 1999/283 (N.I. 1). DARD was renamed the Department of Agriculture, Environment and Rural Affairs by Article 1(2) of the Departments (Northern Ireland) Act 2016 (2016 c.5 (N.I.)).

1972 c. 68. Section 2(2) was amended by section 27(1)(a) of the Legislative and Regulatory Reform Act 2006 (c.51) and section 3(3) of, and Part 1 of the Schedule to, the European Union (Amendment) Act 2008 (c.7) and is prospectively repealed by the European Union (Withdrawal) Act 2018 (c.16), section 1 (see section 20 of that Act).
