Coming into operation in accordance with regulation 1

The Department of Health(1), makes the following Regulations in exercise of the powers conferred by sections 25C(1), (3)(c), (4)(d) and 25F(2) of the Public Health Act (Northern Ireland) 1967(2).

These Regulations are made in response to the serious and imminent threat to public health which is posed by the incidence and spread of severe acute respiratory syndrome coronavirus 2 (SARS-CoV-2) in Northern Ireland.

The Department of Health considers that the restrictions and requirements imposed by these Regulations are proportionate to what they seek to achieve, which is a public health response to that threat.

In accordance with section 25Q of that Act the Department of Health is of the opinion that, by reason of urgency, it is necessary to make these Regulations without a draft having been laid before, and approved by a resolution of, the Assembly.

Citation and commencement

1.—(1) These Regulations may be cited as the Health Protection (Coronavirus, Restrictions) (Amendment No. 10) Regulations (Northern Ireland) 2020 and shall come into operation in accordance with paragraphs (2) to (3).

(2) Regulation 1, 2(1) to (4), (6), (7) (insofar as it relates to regulation 5(2)(v) to (aa)), (8), (9), and (10)(a) and 3 shall come into operation at 11.30 pm on 2nd July 2020.

(3) The remainder of the Regulations shall come into operation at 11.00 pm on 5th July 2020.

Amendment of the Health Protection (Coronavirus, Restrictions) Regulations (Northern Ireland) 2020

2.—(1) The Health Protection (Coronavirus, Restrictions) Regulations (Northern Ireland) 2020(3) are amended as follows.

(2) Omit regulation 3(1).

(3) In regulation 3(2A)(a) for “only food or both food and intoxicating liquor”, substitute “intoxicating liquor, with or without food,”.

(4) In regulation 3(5)—

(a)in sub-paragraph (a), for “paragraphs 5, 6, 8, 9 or 10” substitute “paragraphs 5, 6, 8 or 9”; and

(b)in sub-paragraph (c), for “paragraphs 5, 6, 7, 9 or 10” substitute “paragraphs 5, 6, 7 or 9”.

(5) In regulation 4(2), for “paragraph 13, 15 or 16” substitute “paragraph 13”.

(6) For regulation 5(2)(g), substitute—

(g)to attend a funeral;.

(7) In regulation 5(2)—

(a)for the second reference to sub-paragraph (v) to sub-paragraph (y), substitute—

(w)to visit a nail, beauty or hair salon, a barbers shop, a shop providing tanning, electrolysis or acupuncture services;

(x)to travel for the purpose of staying in holiday accommodation or a second home;

(y)to attend a visitor attraction, museum or gallery;

(z)to visit a restaurant, café, club, public house or bar;;

(b)after sub-paragraph (z), insert—

(aa)to visit a betting shop;

(bb)to visit a massage, tattoo or piercing parlour;

(cc)to visit a spa..

(8) In regulation 6—

(a)for paragraphs (h) and (i), substitute—

(h)to attend a visitor attraction, museum or gallery;

(i)to visit a restaurant, café, registered club, public house or bar;;

(b)after paragraph (j), insert—

(j)to attend a summer school or scheme..

(9) In Part 1 of Schedule 2, after paragraph 2 insert—

3.  Clubs registered in accordance with the Registration of Clubs (Northern Ireland) Order 1996.

(10) In Part 2 of Schedule 2—

(a)omit paragraphs 10, 11 and 12;

(b)for paragraph 13, substitute “Spas, insofar as they provide services involving water or steam”;

(c)omit paragraphs 15 and 16.

Savings

3.  Regulations 8 and 9 of the Health Protection (Coronavirus, Restrictions) Regulations (Northern Ireland) 2020 continue to have effect in relation to any offence committed, or reasonably believed to have been committed, before these Regulations came into operation as if the amendments set out in regulation 2 had not been made.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Health Protection (Coronavirus, Restrictions) Regulations (Northern Ireland) 2020 in order to:

  • permit the re-opening of museums, galleries and betting shops from 3 July;

  • permit the re-opening of massage, tattooing & piercing businesses from 6 July;

  • permit the re-opening of spas from 6 July, but not insofar as they provide services relating to water or steam;

  • permit the restricted opening of restaurants and bars in registered clubs from 3 July;

  • to ensure that funerals are no longer restricted to close family or friends;

  • to allow for attendance at a summer school or scheme; and

  • to correct the numbering of sub-paragraphs and ensure that beer gardens can sell intoxicating liquor without food.

No impact assessment has been prepared for these Regulations.
