The Department of Health(1) makes the following Regulations in exercise of the powers conferred by sections 25B and 25F(2) of the Public Health Act (Northern Ireland) 1967(2).

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Health Protection (Coronavirus, International Travel) (2021 Consolidation) (Amendment No. 6) Regulations (Northern Ireland) 2021 and shall come into operation at 4.00 a.m. on 30th August 2021.

(2) In these Regulations—

“the principal Regulations” means the Health Protection (Coronavirus, International Travel) Regulations (Northern Ireland) 2021(3).

Amendment of the Health Protection (Coronavirus, International Travel) Regulations (Northern Ireland) 2021

2.  The principal Regulations are amended in accordance with regulations 3 to 7.

Amendment to regulation 10

3.  In regulation 10(1), after “arrival” insert “but who is not a fully vaccinated amber list arrival as described in regulation 3A”.

Amendment to Schedule 1

4.  In Schedule 1 (Red list countries), at the appropriate place in alphabetical order, insert “Montenegro” and “Thailand”.

Amendment to Schedule 2

5.  In Schedule 2 (Green list countries), at the appropriate place in alphabetical order, insert “the Azores”, “Canada”, “Denmark”, “Finland”, “Liechtenstein”, “Lithuania” and “Switzerland”.

Amendments to Schedule 4

6.—(1) In Schedule 4, in Part 1 (Persons who are exempt), in the table, omit entries 40 and 41.

(2) In Part 2, omit heading “38. UEFA Super Cup invitees and UEFA Super Cup Villarreal attendees” and paragraphs 68 and 69.

Amendments to Schedule 6

7.  In Schedule 6 (Requirement to book and undertake tests (mandatory testing after arrival in Northern Ireland)—

(1) in paragraph 1(1), in the definitions of “approved private provider” and “approved private test”, for “the Department” substitute “the Secretary of State for Health and Social Care”;

(2) in paragraph 4(3), for “But B is not required to isolate under sub-paragraph (2)(c)” substitute “Where a person (“B”) is isolating with P pursuant to the relevant isolation provisions, the requirement to isolate under sub-paragraph (2)(a) does not apply to B”;

(3) for paragraph 12 substitute—

12.  The Secretary of State for Health and Social Care has published details of approved private providers and approved private tests at https://www.find-travel-test-provider.service.gov.uk/test-type/amber..

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Health Protection (Coronavirus, International Travel) Regulations (Northern Ireland) 2021 (“the principal Regulations”).

Regulation 3 makes amendments to regulation 10 of the principal Regulations to clarify that the requirement to self-isolate does not apply to a fully vaccinated amber list arrival as described in regulation 3A of the principal Regulations.

Regulation 4 makes amendments to Schedule 1 of the principal Regulations by adding Montenegro and Thailand.

Regulation 5 makes amendments to Schedule 2 of the principal Regulations by adding the Azores, Canada, Denmark, Finland, Liechtenstein, Lithuania and Switzerland.

Regulation 6 amends Schedule 4 of the principal Regulations by omitting the exemptions for UEFA Super Cup invitees and UEFA Super Cup Villarreal attendees which have now expired.

Regulation 7 makes amendments to Schedule 6 of the principal Regulations to amend the definitions of approved private test and approved private provider and substitute paragraph 12. It also amends paragraph 4(3) of Schedule 6 of the principal Regulations to correct a drafting error.

No impact assessment has been prepared for these Regulations.
