The Department of Agriculture, Environment and Rural Affairs makes these Regulations in exercise of the powers conferred by section 48 of, and paragraph 5 of Schedule 6 to, the Agriculture Act 2020(1),
1.—(1) These Regulations may be cited as The Direct Payments to Farmers (Amendment) Regulations (Northern Ireland) 2022 and come into operation on 1st August 2022.
(2) In these Regulations “Regulation (EU) 1306/2013” means Regulation (EU) No. 1306/2013 of the European Parliament and of the Council on the financing, management and monitoring of the common agricultural policy(2).
(3) The Interpretation Act (Northern Ireland) 1954(3) shall apply to these Regulations as it applies to an Act of the Assembly.
2. Article 75 of Regulation (EU) 1306/2013 is amended as follows –
(a)in paragraph 1(a) substitute “but not before 16 October” with “in any claim year”, and
(b)in paragraph 2 substitute “the verification of eligibility conditions, to be carried out by the relevant authority pursuant to Article 74, has been finalised” with “the administrative checks to be carried out by the relevant authority pursuant to Article 74, have been finalised.”

These Regulations amend Regulation (EU) No. 1306/2013 to enable the Department to make payments to beneficiaries after administrative checks.
Regulation 2 enables payments to be made before 16 October following the completion of administrative checks only.
A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sector is foreseen.
