The Health and Social Care Pension Schemes (Remediable Service) Regulations (Northern Ireland) 2023

The Department of Health makes the following Regulations in exercise of the powers conferred by sections 1(1) and (2)(e), 2(1) and 3(1), (2)(b) and (c) of and paragraph 5 of Schedule 2 to the Public Service Pensions Act (Northern Ireland) 2014 (“the 2014 Act”)(1) and sections 5(1), (5) and 6(a), 6(1), 7(3), 8, 10(1), 11(1) and (5), 12(1) and (3), 18(1) to (3), (5), (6) and (8), 19(1), (4) and (5), 20(1), (2), (4) and (5)(a) and (b), 21 (1)(a), (b) and (e), and (2) to (5), 22(1), (2) (c), (d), (e), (i) and (j) and (6), 23(1), 24(1),25 (1) and (4), 26(1) and (2)(a) to (c), 29(1), (7) and (8), 31(2) and (3) and 37(2) of the Public Service Pensions and Judicial Offices Act 2022(2) (“PSPJOA 2022”).

In accordance with section 3(5) of the 2014 Act, these Regulations are made with the consent of the Department of Finance.

In accordance with section 21(1) of the 2014 Act(3), the Department of Health has consulted such persons or the representatives of such persons as appear to the Department likely to be affected by these Regulations.

In accordance with section 27(1) of PSPJOA 2022, the powers conferred by sections 18 to 26 of that Act are exercised in accordance with Department of Finance directions(4).

Section 21 has been amended by section 94(16) of PSPJOA 2022.

The Public Service Pensions (Exercise of Powers, Compensation and Information) Directions (Northern Ireland) 2023 which came into operation on 9th February 2023.
