The Department of Agriculture, Environment and Rural Affairs makes these regulations in exercise of the powers conferred by section 50 of, and paragraphs 1(1) and 2(2) of Schedule 4 to, the Environment Act 2021 (“the Act”)(1) and now vested in it(2).
The Department of Agriculture, Environment and Rural Affairs makes these Regulations after consultation in accordance with paragraph 8 of Schedule 4 to the Act and is satisfied as to the matters specified in paragraph 9(1) of that Schedule.
1. These Regulations may be cited as the Producer Responsibility Obligations (Packaging Waste) (Amendment No.2) Regulations (Northern Ireland) 2023 and come into operation on 1st February 2024.
2.—(1) The Producer Responsibility Obligations (Packaging Waste) Regulations (Northern Ireland) 2007(3) are amended as follows.
(2) In Schedule 2 (recycling obligations)––
(a)in paragraph 3(4), in the formula, for “72” substitute “75”.

These Regulations amend the Producer Responsibility Obligations (Packaging Waste) Regulations (Northern Ireland) 2007 (S.I. 2007 No. 198) (the “2007 Regulations”). Those Regulations impose on producers obligations to recycle packaging waste in order to attain overall recycling and material-specific recycling targets.
These Regulations update the formula used in the calculation of the amount of glass packaging waste to be recycled by re-melt.
The Department of the Environment was dissolved by section 1(9) of the Departments Act (Northern Ireland) 2016 and, by virtue of Article 8(1)(c) of the Departments (Transfer of Functions) Order (Northern Ireland) 2016, its functions for the purposes of these Regulations were transferred to the Department of Agriculture, Environment and Rural Affairs.
