The Scottish Ministers, in exercise of the powers conferred upon them by section 1(4)(i) of the Breeding of Dogs Act 1973(1) and of all other powers enabling them in that behalf, hereby make the following Regulations:
1.—(1) These Regulations may be cited as the Breeding of Dogs (Licensing Records) (Scotland) Regulations 1999 and shall come into force on 30th December 1999.
(2) These Regulations extend to Scotland only.

2. For the purposes of section 1(4)(i) of the Breeding of Dogs Act 1973, the records referred to in that section shall be in the form set out in the Schedule to these Regulations.

The Breeding of Dogs Act 1973, as amended by the Breeding and Sale of Dogs (Welfare) Act 1999, requires a local authority to have regard to certain matters in determining whether to grant a licence for the keeping of a dog breeding or rearing establishment and about which conditions must be included in the licence. One such matter is that accurate records should be kept at the premises of the establishment and made available for inspection (section 1(4)(i) of the 1973 Act).
These Regulations, which apply to Scotland only, prescribe the form in which those records must be kept.
1973 c. 60. Section 1(4)(i) was inserted by section 2(2) of the Breeding and Sale of Dogs (Welfare) Act 1999 (c. 11). These functions of the Secretary of State were transferred to the Scottish Ministers by virtue of the Scotland Act 1998 (Transfer of Functions to the Scottish Ministers etc.) (No. 2) Order 1999 (S.I. 1999/3321)
