The National Health Service (Functions of the Common Services Agency) (Scotland) Amendment Order 2000

The Scottish Ministers, in exercise of the powers conferred upon them by sections 10(3) and (5) and 105(7) of the National Health Service (Scotland) Act 1978(1) and of all other powers enabling them in that behalf, hereby make the following Order:

Citation, commencement and interpretation

1.—(1) This Order may be cited as the National Health Service (Functions of the Common Services Agency) (Scotland) Amendment Order 2000 and shall come into force on 1st July 2000.

(2) In this Order–

“the Act” means the National Health Service (Scotland) Act 1978.

“the principal Order” means the National Health Service (Functions of the Common Services Agency) (Scotland) Order 1974(2).

Amendment of article 3 of the principal Order

2.  In article 3 of the principal Order–

(a)sub-paragraph (d) is deleted;

(b)in sub-paragraph (g) for the words “Scottish Dental Estimates Board” there are substituted the words “Scottish Dental Practice Board”;

(c)in sub-paragraph (k) after the words “the provision of legal services to Health Boards” there are inserted the words “, Special Health Boards and NHS trusts”; and

(d)after sub-paragraph (m) there is added–

(n)the provision of research and development services in the field of public health;

(o)the prevention, detection and investigation of fraud or other irregularities in relation to the provision of general medical, dental, and ophthalmic services, pharmaceutical services and personal medical services under the Act..

Explanatory Note

(This note is not part of the Order)

This Order further amends the National Health Service (Functions of the Common Services Agency) (Scotland) Order 1974 (“the principal Order”).

This Order amends the principal Order by giving to the Common Services Agency (“the CSA”) the function of research and development services in the field of public health. It also gives the CSA the function of preventing, detecting and investigating fraud or other irregularities in relation to the provision of general medical, dental, and ophthalmic services, pharmaceutical services and personal medical services in Scotland.

The Order also amends the principal Order to delete reference to the provision by the CSA of an ambulance service, as the Scottish Ambulance Service Board undertakes that function. It also deletes reference in the principal Order to the Scottish Dental Estimates Board and substitutes reference to the Scottish Dental Practice Board, to reflect the previous change of name of the Board. The Order also gives the CSA the function of providing legal services to Special Health Boards and NHS trusts, as well as to Health Boards.
