The Scottish Ministers, in exercise of the powers conferred by section 34A(10) of the Law Reform (Miscellaneous Provisions) (Scotland) Act 1990(1) and of all other powers enabling them in that behalf, hereby make the following Order:

Citation and commencement

1.  This Order may be cited as the Scottish Legal Services Ombudsman (Compensation) (Prescribed Amount) Order 2002 and shall come into force on 28th February 2002.

Prescribed amount

2.  For the purposes of section 34A of the Law Reform (Miscellaneous Provisions) (Scotland) Act 1990 the prescribed amount is £1,200.

Explanatory Note

(This note is not part of the Order)

This Order prescribes the amount which the stated amount, in terms of section 34A of the Law Reform (Miscellaneous Provisions) (Scotland) Act 1990, cannot exceed.

The stated amount is such compensation payment as may be recommended by the Scottish legal services ombudsman.

The previous prescribed amount was £1,000 and this Order raises that amount to £1,200.

1990 c. 40; section 34A was inserted by section 2 of the Scottish Legal Services Ombudsman and Commissioner for Local Administration in Scotland Act 1997 (c. 35). See the definition of “the prescribed amount” in section 34A(10). The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c. 46).
