The Scottish Ministers, in exercise of the powers conferred by sections 31(3) and 54(2) of the Building (Scotland) Act 2003(1) and of all other powers enabling them in that behalf, hereby make the following regulations:

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Building Standards Advisory Committee (Scotland) Regulations 2004 and shall come into force on 1st January 2005.

(2) In these Regulations “the Committee” means the Building Standards Advisory Committee(2).

(3) In these Regulations, unless otherwise indicated–

(a)any reference to a numbered regulation is to the regulation in these Regulations which bears that number, and

(b)any reference in a regulation to a numbered paragraph is to the paragraph of that regulation which bears that number.

Membership of Committee

2.  The Committee shall consist of no fewer than twelve and no more than eighteen members.

Chairperson

3.—(1) The person who, immediately before 1st January 2005, held the office of Chairman of the Committee shall, subject to paragraph (2), on and after that date, hold office as the Chairperson of the Committee.

(2) Each Chairperson of the Committee (including the Chairperson mentioned in paragraph (1)) shall hold office until that person ceases to hold office as a member of the Committee.

(3) When a Chairperson of the Committee ceases to hold office, the members shall elect one of their number to be the Chairperson of the Committee.

(4) If at any meeting of their Committee the Chairperson is absent the members present shall elect one of its members to preside at that meeting.

Meetings and quorum

4.—(1) The Committee shall meet at such times, and notice of meetings shall be given to the members in such manner, as the Committee may determine.

(2) At a meeting of the Committee six members present shall be a quorum.

(3) No act or proceeding of the Committee shall be questioned on account of any vacancy in their membership.

Procedure

5.  Subject to regulations 2 to 4 the Committee shall regulate its own procedure.

Reports

6.—(1) The Committee shall, by no later than 31st January in each year, submit an annual report to the Scottish Ministers as to the exercise, in the immediately preceding year, of its functions.

(2) Without prejudice to paragraph (1) the Scottish Ministers may require the Committee to submit such other reports as to the exercise of its functions as they may determine from time to time.

Revocation

7.  The Building Standards Advisory Committee (Scotland) Regulations 1959(3) are hereby revoked.

Explanatory Note

(This note is not part of the Regulations)

These Regulations make provision for the constitution and procedure of the Building Standards Advisory Committee which the Scottish Ministers is required to appoint under section 31 of the Building (Scotland) Act 2003.

These Regulations replace and revoke the Building Standards Advisory Committee (Scotland) Regulations 1959.
